.' <br />Resolution No. ~~ <br />A RESOLUTION OF THE SOUTH BEND. REDEVELOPMENT AUTHORITY <br />APPROVING THE TRANSFER OF PROPERTY <br />TO THE CITY OF SOUTH BEND, INDIANA <br />WHEREAS, the South Bend Redevelopment Authority (the <br />Authority) is the owner of the .following described improvements to <br />real property situated in St. Joseph County, Indiana: <br />A pedestrian tunnel and all accessions and fixtures <br />thereto beneath St. Joseph Street, connecting the <br />College Football Hall of Fame and Century Center, <br />all in South Bend, St. Joseph County <br />(hereinafter referred to as the Improvements) and; <br />WHEREAS, the Authority desires to transfer the Improvements to <br />the City of South Bend in consideration of the payment by the City <br />to the Authority of the sum of Six Hundred Thousand Dollars <br />(.$600,000.00); and <br />WHEREAS, the City desires to acquire the Improvements from the <br />Commission upon these terms and conditions; and <br />WHEREAS, I.C. 36-7-14.5 which governs the operations of the <br />Authority fails to establish procedures governing the purchase <br />and/or sale of property by the Authority; but <br />WHEREAS pursuant to its Resolution 33, adopted March 8, 1991, <br />the Authority determined to operate in accordance with the <br />procedures set forth at I.C. 36-1-11-8 with regard to the purchase <br />and sale of property from or to another governmental entity; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend, <br />acting by and through the Board, may exchange or transfer property <br />with another governmental entity upon terms and conditions agreed <br />upon by the two (2) entities as evidenced by the adoption of <br />substantially identical resolutions of each entity. <br />NOW, THEREFORE, BE' IT RESOLVED BY THE SOUTH BEND <br />REDEVELOPMENT AUTHORITY AS FOLLOWS: <br />1. That the transfer of the following described <br />improvements to real property situated in St. Joseph County, <br />Indiana by the South Bend Redevelopment Authority to the. City of <br />South Bend, Indiana: <br />A pedestrian tunnel and all accessions and fixtures <br />thereto beneath St. Joseph Street, connecting the <br />College Football Hall of Fame and Century Center, all <br />• in South Bend, St. Joseph County <br />
