Qtoututitt *oat: <br /> Zoning anZi finnuation tontinittet <br /> The March 12, 2001 meeting of the Zoning and Annexation Committee was called to order by its <br /> Chairperson,Council Member Karen White at 4:00 p.m. in the Council Informal Meeting Room. <br /> Persons in attendance included Council Members: Aranowski, Pfeifer, King, Kelly, Varner, <br /> Ujdak, Coleman, White and Kirsits; Community and Economic Development Director Jon Hunt, <br /> Historic Preservation Commission Acting Director John Oxian, Assistant Area Plan Director John <br /> Byomi, Attorney Bruce Bancroft, City Engineer Carl Littrell. Michael Dansch, Ted Foti of <br /> Memorial Hospital, Mayor's Administrative Assistant Fred Thon, Public Works Director Gary <br /> Gilot, Terry Bland of the i+outJj Venti tribunt, and Kathleen Cekanski-Farrand, Council <br /> Attorney. <br /> Council Member White noted that the first item on the agenda was to review Bill No. 10-01 which <br /> is a request to establish an historic landmark for the railroad bridge located across the St. Joseph <br /> River which is adjacent to the Angela Street Bridge. <br /> Historic Preservation Commission Acting Director John Oxian stated that the Historic Preservation <br /> Commission is recommending that the Norfolk & Southern Railroad Bridge be designated as a <br /> local landmark. It is believed to have been constructed in the mid 1890's which consists of a deck <br /> plate girder bridge with four(43) concrete supports, iron girder and plat deck. It meets three 3 <br /> local criteria for local designation. ( ) <br /> The Council Attorney noted that she has been in contact with the attorney representing the railroad <br /> who has raised a federal pre-emption issue with regard to the proposed action. She requested that <br /> the Bill be continued until the Council meeting of April 9th to allow herself and the Legal <br /> Department to continue discussions with the railroad's legal counsel. <br /> Mr. Oxian consented to the continuance request however noted that prior to legal counsel for the <br /> railroad becoming involved that the railroad had proposed to donate the railroad bridge to the City. <br /> Following discussion, Council Member Varner made a motion, seconded by Council Member <br /> Coleman that Bill No. 10-01 be continued until the April 9th Council meeting. The motion passed. <br /> The Committee then reviewed Bill No. 3-01 which is a request to rezone the property located at <br /> 814 and 816 North Main Street. <br /> Area Plan Assistant Director John Byomi noted that the staff and the Area Plan Commissio <br /> recommend Bill No. 3-01 favorably to Council. n <br /> Mr. Bruce Bancroft the attorney for the Petitioner, Memorial Hospital made the presentation. He <br /> noted that the rezoning would permit a parking lot to be constructed for employees of Memorial. <br /> Following discussion, Council Member Coleman made a motion, seconded by Council Member <br /> Varner that Bill No. 3-01 be recommended unfavorably to Council. The motion passed. Council <br /> Member Coleman noted that he was able to retrieve a brick from what once was his grandfather's <br /> home from this location. <br /> The Committee then reviewed Substitute Bill No. 4-01 which is a rezoning request for the property <br /> located at 109 South St. Louis and 616 Fast Washington Street. <br />
