p +~i. <br />.t,y <br />RESOLUTION NO. 28 <br />RESOLUTION OF THE SOUTH BEND REDEVELOPMENT <br />AUTHORITY APPROVING AN AMENDED AND RESTATED <br />LEASE BETWEEN THE REDEVELOPMENT AUTHORITY <br />AND THE SOUTH BEND REDEVELOPMENT COMMISSION <br />FOR THE AIRPORT ECONOMIC DEVELOPMENT AREA <br />PUBLIC IMPROVEMENT PROJECT <br />WHEREAS, the South Bend Redevelopment Authority (the <br />"Authority") on November 8, 1990 adopted its Resolution No. 25 <br />which, among other things, authorized the Authority to enter into <br />a Lease between the Authority and the South Bend Redevelopment <br />Commission (the "Commission") dated August 1, 1990 (the "Lease") <br />for the Airport Economic Development Area Public Improvement <br />Project (the "Project"); and <br />WHEREAS, the Commission on November 9, 1990 adopted its <br />Resolution No. 964 which, among other things, authorized the <br />Commission to execute the Lease; and <br />WHEREAS, the Authority on December 17, 1990 adopted its <br />Resolutions Nos. 26 and 27, which authorized the issuance of the <br />"South Bend Redevelopment Authority Taxable Lease Rental Revenue <br />Bonds (Airport Economic Development Area Public Improvement <br />Project)" (the."Taxable Bonds") and the "South Bend Redevelopment <br />Authority Lease Rental Revenue Bonds (Airport Economic <br />Development Area Public Improvement Project)" (the "Tax Exempt <br />Bonds"), respectively (collectively the "Bond Resolutions"); and <br />WHEREAS, the adoption of the Bond Resolutions requires <br />certain amendments to the Lease to, among other things, provide <br />for separate lease rental payments for the portions of the <br />
