' <br />Dear Sirs: - <br />This letter wi11 confirm the verbal understanding between the Board of <br />Public Works and the Chicago, South Bend & Northern Indiana Railway Company in regard to <br />the paving of South M#chigan Street from a point 40 feet north of Fairview Street to <br />Donmeyer Avenue. <br />on account of the new condition created by the surrender of the Railway <br />Company's franchises, whereby the railway Company is relieved of the necessity of paying <br />for that portion of the pavement between its rails, and for one foot outside ofits <br />rails, the Railway Company has.agreed titb the Board of Public Works as follows: <br />First; The Railway Company at its expense, will lay a new track in the <br />center of the street from a ill also 40 thefeet curveofrom the eenter ofof Fairview reet to Michiganakaide StreetSleading <br />The Railway Company y <br />into Oakside, Street. <br />Second: The abutting property ewners will pay for the cost of the pavement <br />exactly tly the same basis as if there were no track in the street. <br />i Third: Any additional cost of.the pavement Which is caused by the location <br />of the railway track in the street, over and above what the cost would be 3f there <br />were no tract in the street, is to be btrme by the Railway Company . <br />the last paragraph In explanation of it is understood that if any additiond <br />concrete is needed to suppport the track of the Railway Company, that ext a concrete is <br />to be paid for by the Railway Company.
