c~~~~~ <br />INTERLOCAL AGREEMENT BY AND AMONG <br />THE SOUTH BEND PARKS BOARD, <br />THF, SOUTH BF,ND BOARD OF PUBLIC WORKS <br />AND THE SOUTH BEND REDEVELOPMENT COMMISSION <br />(Animal Shelter Project) <br />THIS AGREEMENT is entered into and made effective the day of , <br />2010, by and among the South Bend Department of Parks and Recreation, by and through the <br />South Bend Parks Board, the South Bend Department of Public Works, by and through the South <br />Bend Board of Public Works, and the South Bend Department of Redevelopment, by and <br />through the South Bend Redevelopment Commission. <br />RECITALS <br />WHEREAS, the South Bend Department of Parks and Recreation ("Parks") and the <br />South Bend Department of Public Works ("Public Works") are each departments within a <br />municipal corporation existing and operating as a political subdivision of the State of Indiana as <br />defined by Ind. Code § 36-I-2-13 and are authorized enter into an interlocal agreement pursuant <br />to Ind. Code § 36-1-7-4; and <br />WHEREAS, the South Bend Department of Redevelopment ("Redevelopment") is a <br />public corporate body created by Indiana law; and <br />WHEREAS, the South Bend Parks Board ("Parks Board") is the governing body of <br />Parks; and <br />WHEREAS, the South Bend Board of Public Works ("BPW") is the governing body of <br />Public Works; and <br />WHEREAS, the South Bend Redevelopment Commission ("Commission") is the <br />governing body of Redevelopment; and <br />WHEREAS, Parks is the owner of the real estate and facility generally known as <br />Kennedy Park located in South Bend; and <br />WHEREAS, Parks desires to remodel the building located at 521 Eclipse Place to <br />become the new state of the art animal shelter for South Bend Animal Care and Control (the <br />"Project"); and <br />WHEREAS, Redevelopment has the resources to fund the Project; and <br />WHEREAS, Public Works has the expertise and procedures in place to contract for and <br />administer the Project; and <br />
