c~~~~~ INTERLOCAL AGREEMENT BY AND AMONG THE SOUTH BEND PARKS BOARD, THF, SOUTH BF,ND BOARD OF PUBLIC WORKS AND THE SOUTH BEND REDEVELOPMENT COMMISSION (Animal Shelter Project) THIS AGREEMENT is entered into and made effective the day of , 2010, by and among the South Bend Department of Parks and Recreation, by and through the South Bend Parks Board, the South Bend Department of Public Works, by and through the South Bend Board of Public Works, and the South Bend Department of Redevelopment, by and through the South Bend Redevelopment Commission. RECITALS WHEREAS, the South Bend Department of Parks and Recreation ("Parks") and the South Bend Department of Public Works ("Public Works") are each departments within a municipal corporation existing and operating as a political subdivision of the State of Indiana as defined by Ind. Code § 36-I-2-13 and are authorized enter into an interlocal agreement pursuant to Ind. Code § 36-1-7-4; and WHEREAS, the South Bend Department of Redevelopment ("Redevelopment") is a public corporate body created by Indiana law; and WHEREAS, the South Bend Parks Board ("Parks Board") is the governing body of Parks; and WHEREAS, the South Bend Board of Public Works ("BPW") is the governing body of Public Works; and WHEREAS, the South Bend Redevelopment Commission ("Commission") is the governing body of Redevelopment; and WHEREAS, Parks is the owner of the real estate and facility generally known as Kennedy Park located in South Bend; and WHEREAS, Parks desires to remodel the building located at 521 Eclipse Place to become the new state of the art animal shelter for South Bend Animal Care and Control (the "Project"); and WHEREAS, Redevelopment has the resources to fund the Project; and WHEREAS, Public Works has the expertise and procedures in place to contract for and administer the Project; and
