REGULAR MEETING AUGUST 24, 1970 <br />I1REGULAR MEETING - RECONVENED <br />Be it remembered that the Common Council of the City of South Bend, Indiana, reconvened in the <br />Council Chambers in the County -City Building on Monday, August 24, 1970, at 8:31 p.m. all <br />members present. The meeting was called to order by Council - President Robert 0. Laven, who <br />presided. <br />REPORT FROM COMMITTEE ON MINUTES <br />ITo the Common Council of the City of South Bend: <br />Your Committee on the inspection and supervision of the minutes would respectfully report that <br />they have inspected the minutes of the July 20, 1970, Special Meeting; July 27, 1970, Regular <br />Meeting; July 29, 1970, Special Meeting; and August 19, 1970 Regular Meeting of the Council and <br />found them correct. They therefore recommend that the same be approved. <br />/s/ Robert 0. Laven <br />%s/ Janet S. Allen <br />s Albert E. Palmer <br />There being no objections, the report was accepted as read and placed on file. <br />(CITIZENS REQUESTS - MISCELLANEOUS MATTERS <br />Mrs. Frederick Mutzel, 320 Parkovash, South Bend, inquired about the firm engaged by the City to <br />study City water rates to determine whether or not rates should be raised. Council - President <br />Laven said this matter would not come before the Council. City Controller James A. Bickel, stated <br />that an outside consultant firm will make the study because it is the only firm qualified to do so. <br />4irs. Mutzel said she believed a local firm should make the study. Mr. Bickel said only the Indi- <br />iana Public Service Commission can approve a rate increase. <br />Mr. Grady L. Thompson inquired about water rates and Council President Laven recommended that he <br />contact Mr. Hunter, Director of Utilities. <br />Council President Laven denied a charge from Mrs_. Bloomhour, Arnold Street, South Bend, that the <br />City is blacktopping alleys at City cost. Councilman Zielinski stated the area she was referring <br />to was the LaSalle Park and it was blacktopped with Federal money. <br />Councilman Janet S. Allen commended the Downtown Council and merchants who helped the two - hundred <br />young people put on the music and style show Saturday, August 22, 1970, in the Morris Auditorium. <br />She said the students did the work themselves and they were to be congratulated on the wonderful <br />program they produced, with the cooperation of various city departments. <br />Mr. Gerry Schultz, Evergreen Lane, South Bend, complained about the condition of his street and <br />said no action has been taken since the matter was discussed with the Council at the past meeting. <br />Councilman Zielinski read a city report from the Engineering Department explaining that the <br />Street was an unimproved street and therefore, is the responsibility of abuting property owners <br />to finance for improvement under the Barrett Law. The report stated it would cost each property <br />owner (one lot) about $676.00. <br />REPORT FROM THE CITY CONTROLLER <br />The Controllers Report for the month of June, 1970 was submitted by City Controller James A. <br />Bickel. Each Councilman had received a copy of the report before the meeting and there being no <br />questions, the report was accepted as submitted and placed on file. <br />REPORT FROM AREA PLAN COMMISSION <br />August 21, 1970 <br />The Honorable City Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />Re: Ord. 5222 -70 <br />(Edison Rd. & South Bend Ave., <br />Notre Dame) <br />The Ordinance amending and supplementing Ordinance 4990 -68 - Chapter 40 of the Municipal Code <br />(Formerly Zoning Ordinance 3702) as amended, was referred back to the Area Plan Commission <br />by the Common Council for approval of the corrected legal description due to the realignment <br />of the property. <br />The following action was taken on August 18, 1970: <br />After due consideration, it was moved by Mr. Taylor, seconded by <br />Jerry Miller, that the Area Plan Commission approve the ordinance <br />as amended and it is recommended favorably to the Common Council' <br />as amended. <br />The deliberations of the Area Plan Commission and points considered in arriving at the above <br />decision are shown in the excerpts of the minutes attached hereto and made a part of this report. <br />Very truly yours, <br />/s/ Howard Bellinger, <br />Executive Director <br />HB:eb <br />Attach. <br />There being no objections, the report was accepted and placed on file. <br />
