<br />REGULAR MEETING JANUARY 22, 1979 
<br />Council Member Serge made a motion that the minutes of the December 11, 1979, meeting of the 
<br />Council be accepted and placed on file, seconded by Council Member Dombrowski. The motion 
<br />carried. 
<br />SPECIAL BUSINESS 
<br />Council President Parent announced that the Mayor had requested approval of the following people 
<br />for appointment to the Fair Campaign Practices Commission: George T. Patton - Democrat, Joseph 
<br />Baldoni- Democrat, Ruth Roll- Republican, Carl A. Fisher, Jr.- Republican. Council Member Miller 
<br />made a motion to approve these appointments, seconded by Council Member Adams. The motion 
<br />carried. Council Member Dombrowski made a motion that the City Clerk send a letter to each 
<br />member of the Commission, indicating that it is understood by the Council that none of the 
<br />members of the Commission will become involved in any individual's campaign, seconded by 
<br />Council Member Adams. The motion carried. 
<br />Council Member Dombrowski made a motion to resolve into the Committee of the Whole, seconded by 
<br />Council Member Adams. The motion carried. 
<br />COMMITTEE OF THE WHOLE 
<br />Be it remembered that the Common Council of the City of South Bend met in the Committee of the 
<br />Whole on Monday, January 22, 1979, at 7:05 p.m., with nine members present. Chairman Frank 
<br />Horvath presiding. 
<br />BILL NO. 5 -79 
<br />A BILL APPROVING THE FORM AND TERMS OF LOAN AGREEMENT, TRUST 
<br />INDENTURE, NOTE, MORTGAGE AND INDUSTRIAL DEVELOPMENT REVENUE 
<br />BONDS, AND AUTHORIZING THE EXECUTION THEREOF PERTAINING TO 
<br />ANCHOR PROPERTIES, II, AN INDIANA PARTNERSHIP. 
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponent: 
<br />were given an opportunity to be heard. Mr. Kenneth Fedder, attorney for the Economic Developmen- 
<br />Commission, made the presentation for the bill. He indicated that the $400,000 bond issue would 
<br />be used to construct an addition and purchase equipment to the present location of Anchor 
<br />Properties at 807 E. Jefferson. He said this new facility will employ approximately twelve new 
<br />people. Council Member Adams made a motion to recommend this bill to the Council favorable, 
<br />seconded by Council Member Serge. The motion carried. 
<br />BILL NO. 1 -79 A BILL AMENDING CHAPTER 15, ARTICLE I, OF THE MUNICIPAL CODE 
<br />OF THE CITY OF SOUTH BEND, COMMONLY KNOWN AS THE RAILROAD 
<br />TRAINS ORDINANCE. 
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponent 
<br />were given an opportunity to be heard. Mr. Jim Masters, Assistant City Attorney, made the 
<br />presentation for the bill. He indicated this amendment to the ordinance was ordered by the 
<br />Public Service Commission so that the ordinance will conform to the State statutes. He said 
<br />this amendment would prohibit train bills, horns, and whistles. Council Member Adams indicated 
<br />that this bill should be amended to correct the section reference. She made a motion to amend 
<br />the code section reference to 15 -3.1, seconded by Council Member Kopczynski. The motion carried 
<br />Council Member Adams made a motion to recommend this bill to the Council favorable, as amended, 
<br />seconded by Council Member Dombrowski. The motion carried. 
<br />BILL NO. 3 -79 A BILL AMENDING CHAPTER 13, ARTICLE 4, OF THE MUNICIPAL CODE 
<br />OF THE CITY OF SOUTH BEND BY ADDING A NEW SECTION 13 -55.1 
<br />DEFINING THE OFFENCE OF LOITERING FOR SOLICITATION AND 
<br />ESTABLISHING A PENALTY FOR THE VIOLATION THEREOF. 
<br />This being the time theretofore set for public hearing on the above bill, proponents and opponen 
<br />were given an opportunity to be heard. Mr. Jim Masters, Assistant City Attorney, made the pre- 
<br />sentation for the bill. He indicated that many neighborhood residents and businessmen in the 
<br />South Michigan Street area and other areas of the City have long compalined about the activity 
<br />of known prostitutes and panderers who loiter in this area to the detriment of the public peace 
<br />and safety. He said this bill would curb such conduct by establishing a rigorour fine to be 
<br />imposed upon persons who are found guilty of violating its provisions. Vincent Smith, Captain, 
<br />South Bend Police Department, indicated that the police department cannot stop prostitution, 
<br />but they can control it, and this bill would enable them to better serve the public. Council 
<br />Member Adams made a motion to recommend this bill to the Council favorable, seconded by Council 
<br />Member Taylor. The motion carried. 
<br />BILL NO. 4 -79 
<br />A BILL AMENDING CHAPTER 21, ARTICLE 7, SECTION 21 -120 OF THE 
<br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, BY REQUIRING 
<br />THAT PROPOSED REZONINGS BE ADVERTISED BY COMMON ADDRESS AND 
<br />THAT THE PROPERTY HAVE A PUBLIC NOTICE POSTED THEREON. 
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponent: 
<br />were given an opportunity to be heard. Council Member Adams made the presentation for the bill. 
<br />She indicated that in order to provide better information and ntoice to the public on proposed 
<br />rezonings, this bill contained two basic provisions. She said it would require that the street 
<br />address of the proposed rezoning be advertised, and that a public notice be posted on the proper-. 
<br />indicating its existing and requested zoning classifications, the dates, times and places of the 
<br />public hearings before the Area Plan Commission and the Common Council. Mrs. Jane Swan, 2022 
<br />Swygart, spoke in favor of this bill. Council Member Taylor made a motion to recommend this 
<br />bill to the Council favorable, secnded by Council President Parent. The motion carried.
