REGULAR MEETING JANUARY 22, 1979 COMMITTEE OF THE WHOLE MEETING (CONTINUED BILL NO. 6 -79 A BILL APPROVING A CONTRACT BETWEEN THE BUREAU OF WATER OF THE CITY OF SOUTH BEND, INDIANA, AND PEERLESS- MIDWEST, INC., GRANGER, INDIANA, FOR THE CONSTRUCTION OF AIRPORT NO. 4 IN THE TOTAL AMOUNT OF $37,132. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. John Stancati, Director of Utilities, made the pre- sentation for the bill. He indicated this bill would allow them to construct a new well. He said Peerless - Midwest had submitted the best and lowest bid for the construction of this well. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Parent. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Dombrows. made a motion to rise and report to the Council, seconded by Council Member Adams. The motion carried. BILLS. SECOND READING ORDINANCE NO. 6544 -79 AN ORDINANCE APPROVING THE FORM AND TERMS OF LOAN AGREEMENT, TRUST INDENTURE, NOTE, MORTGAGE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND AUTHORIZING THE EXECUTION THEREOF PERTAINING TO ANCHOR PROPERTIES, II, AN INDIANA PARTNERSHIP. This bill had second reading. Council Member Taylor made a motion to pass this bill, seconded by Council Member Szymkowiak. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 6545 -79 AN ORDINANCE AMENDING CHAPTER 15, ARTICLE I, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, COMMONLY KNOWN AS THE RAILROAD TRAINS ORDINANCE. This bill had second reading. Council Member Taylor made a motion to amend this bill, as amended in the Committee of Whole, seconded by Council Member Szymkowiak. The motion carried. Council Member Taylor made a motion to pass this bill, as amended, seconded by Council Member Adams. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 6546 -79 AN ORDINANCE AMENDING CHAPTER 13, ARTICLE 4, OF THE MUNICIPAL CODE OF.THE CITY OF SOUTH BEND BY ADDING A NEW SECTION 13 -55.1 DEFINING THE OFFENSE OF LOITERING FOR SOLICITATION AND ESTABLISHING A PENALTY FOR THE VIOLATION THEREOF. This bill had second reading. Council Member Serge made a motion to pass this bill, seconded by Council Member Dombrowski. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 6547 -79 AN ORDINANCE AMENDING CHAPTER 21, ARTICLE 7, SECTION 21 -120 OF THE MUNICIPAL CODE. OF THE CITY OF SOUTH BEND, INDIANA, BY REQUIRING THAT PROPOSED REZONINGS BE ADVERTISED BY COMMON ADDRESS AND THAT THE PROPERTY HAVE A PUBLIC NOTICE POSTED THEREON. This bill had second reading. Council Member Adams made a motion to pass this bill, seconded by Council Member Dombrowski. The bill passed by a roll call vote of nine ayes.
