..., , <br />•> = <br />REGULAR MEETING <br />JUNE 13, 2006 <br />They have successfully completed a twenty (20) week recruit school, have successfully completed <br />the physical and psychological testing required by State Law, and have been accepted into the <br />Indiana Firefighters 1997 Pension Fund. Chief Taylor recommended the hiring be effective June 13, <br />2006. Upon a motion made by Ms. Dempsey, seconded by Mr. BonDurant and carried, the <br />recommendation was approved. <br />Ms. Mary Beth Wisniewski, Chief Deputy City Clerk, was present and administered the Oath of <br />Office to the above listed individuals. The Board wished them well in their endeavors with the <br />South Bend Fire Department. Chief Luther Taylor pinned each Firefighter with their badges, and <br />presented their helmet shields. <br />The Board recessed at 9:23 a.m., and reconvened at 9:25 a.m. <br />ACCEPT AND APPROVE PROMOTIONS -PETE PAJAKOWSKI, BRIAN REPLOGLE, TOM <br />MEGYESE, CRAIG FRUTH, JASON BANGO, ELIZABETH HERTEL, KEVIN KURTZ, STEVE <br />GERVAIS <br />Chief Luther Taylor recommended that the above listed individuals be promoted to the rank of <br />Engineer, effective June 18, 2006, in conjunction with satisfactorily completing three (3) years with <br />the Department. Upon a motion made by Ms. Dempsey, seconded by Mr. BonDurant and carried, <br />the promotions were accepted and approved. <br />CONTINUANCE OF HEARING -CHARGE 06-06 -BRIAN BARTLETT <br />Upon a motion made by Ms. Dempsey, seconded by Mr. BonDurant and carried, the hearing date for <br />Mr. Bartlett originally scheduled for June 21, 2006 was continued to August 30, 2006, at 8:30 a.m. <br />FINDINGS OF FACT -CHARGE 06-OS -JAMES BURKUS <br />In a previous Board of Public Safety meeting, the Board found that for his actions, Captain James A. <br />Burkus shall be demoted to the rank of Engineer in the South Bend Fire Department for an indefmite <br />period starting May 24, 2006 and shall also be suspended without pay from the South Bend Fire <br />Department for a period of twenty (20) consecutive days starting May 24, 2006. Upon a motion <br />made by Ms. Dempsey, seconded by Mr. BonDurant and carried, the Findings of Fact were signed. <br />POLICE DEPARTMENT <br />ACCEPT AND APPROVE 2006 THROUGH 2008 WORKING AGREEMENT -FRATERNAL <br />ORDER OF POLICE -SOUTH BEND LODGE N0.36 <br />City Attorney Chuck Leone presented the 2006 through 2008 Working Agreement for Board <br />approval. Chief Thomas Fautz commended the Fraternal Order of Police for professional <br />negotiations. There being no further discussion, upon a motion made by Mr. Cottrell, seconded by <br />Mr. Alford and carried, the 2006 through 2008 Working Agreement was accepted and approved. <br />ACCEPT AND APPROVE PROPOSED CHANGES TO THE SOUTH BEND POLICE <br />DEPARTMENT DUTY MANUAL IN THE FORM OF GENERAL ORDERS <br />- CAMERA: FILM, DIGITAL, POLAROID AND VIDEO <br />-USE OF FORCE <br />- SHOPLIFTING AFFIDAVIT <br />-MOBILE VIDEO/AUDIO RECORDING <br />- REPORTING VEHICLE PURSUITS <br />- TRAFFIC CITATION ACCOUNTABILITY <br />-CCTV: DOWNTOWN VIDEO CAMERAS <br />- JUVENILE OPERATIONS <br />- STOP AND FRISK <br />- MISSING PERSONS <br />Chief Thomas Fautz submitted the above referenced changes to the South Bend Police Department <br />Duty Manual in the form of General Orders. The ten (10) sections are replacing certain Duty Manual <br />sections. Chief Fautz stated the changes are self-explanatory. The Police Department will continue <br />to update the Duty Manual. Upon a motion made by Mr. Cottrell, seconded by Mr. Alford and <br />carried, the changes in the form of General Orders to the South Bend Police Department were <br />1 <br />1 <br />1 <br />accepted and approved. <br />
