South Bend Redevelopment Commission
Regular Meeting –September 18, 2009

6. NEW BUSINESS (CONT.)

B. South Bend Central Development Area

(2) continued…

Commission would be responsible for
providing a Phase I Environmental Site
Assessment if the purchaser requests it.
The last change was in Exhibit B noting that
the Bid Specifications will be considered
when considering a proposal.

Mr. Varner questioned the logic of being so
restrictive in offering the property. He didn’t
want a potential developer to be turned off by
restrictions. He would want them to bring
forward any proposal for the Commission’s
consideration. Mr. Inks responded that that
is the intent. CBRE will bring all proposals
to the Commission, but we wanted CBRE to
understand that the Commission may not
accept just any proposal brought forward.

Mr. Varner said he thought that putting that
statement in writing might scare off an
interested buyer. Mr. Inks noted that this is
our agreement with CBRE. It won’t be seen
by a potential buyer.

Mr. Gibney noted that, particularly for the
Colfax and Hill site, there has been
significant East Bank neighborhood and
business input into a master plan for that lot.
They wouldn’t want to see the city disregard
that plan. If there is a proposal that is
significantly outside that plan, there should
be discussion about whether to accept the
proposal.

Ms. King asked whether the price shown in
Exhibit B is the listing price.
