5 Criteria (per IC 36 -7 -4 -603): <br />1. Comprehensive Plan: <br />Policy Plan: <br />City of South Bend - City Plan, November 2006 <br />Housing Policy H 5.1 Promote the variety, style, and affordability of housing stock. <br />Housing Policy H 3.1 Encourage housing opportunities for low income households <br />throughout the city to avoid concentration in any one area. <br />The rezoning is consistent with the Comprehensive Plan's Housing Policies. <br />Land Use Plan: <br />City of South Bend - City Plan, November 2006 <br />The Future Land Use Map identifies this area as Medium Density Residential. <br />The rezoning is consistent with the Comprehensive Plan's Future Land Use Map. <br />2. Current conditions and character: <br />The site is currently vacant land. The area is a mixture of commercial and residential in <br />character. <br />3. Most desirable use: <br />The most desirable uses for the property are office or residential. <br />4. Conservation of property values: <br />The commercial property values to the east should not be affected by the rezoning. The <br />surrounding residential property values may be negatively affected by the rezoning. <br />5. Responsible development and growth: <br />It is responsible development and growth to allow infill development on an underutilized <br />property. <br />Recommendation: <br />Based on information available prior to the public hearing, the staff recommends this petition be <br />sent to the Common Council with a favorable recommendation subject to written commitments <br />stating that an ingress & egress cross - access easement be placed on the property running from the <br />McKinley Avenue to the commercial area east of the northern portion of the site. <br />Analysis: <br />The proposed development would serve as a buffer between the commercial development to the <br />east and the residential areas to the north and west. The addition of the required landscaping and <br />building setbacks should further buffer the surrounding single family areas from the proposed <br />development. A portion of the proposed site was previously zoned B Multi Family District prior <br />to the adoption of the new zoning ordinance in 2004. The proposed written commitment would <br />ensure continued access to the commercial area from McKinley as it presently exists and a second <br />access to the apartments from the commercial area. <br />BRC South Bend, L.L.C. <br />#2461 -08 <br />Page 2 of 3 <br />
