Approving the Sale of Park Property

(hereinafter, the "Real Property"). Pursuant to I.C. 36-10-4-9(a), said lands are under the exclusive control of the Board of Park Commissioners of the Park District of the City (hereinafter, the "Park Board"). The Real Property is located adjacent to the site of the new Riley High School being constructed by the South Bend Community School Corporation (the "School Corporation") but is no longer needed for park purposes. At its meeting of March 17, 1997, the Park Board determined that the Real Property is not required for park purposes and authorized the sale of the Real Property upon the conditions that the Real Property be transferred to the School Corporation for the sum of One Hundred Thirty-six Thousand and 00/100 Dollars ($136,000.00) for use in its Riley High Project. Pursuant to I.C. 36-10-4-18, Common Council approval of the sale of the Real Property is required. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. The disposal of the Real Property is approved, subject to the condition that the Real Property be transferred to the School Corporation for the sum of One Hundred Thirty-six Thousand and 00/100 Dollars ($136,000.00) for use in its Riley High Project. Section II.
