ORDINANCE NO. ~~ / i <br />AN ORDINANCE OF THE COMMON COUNCIL <br />OF THE CITY OF SOUTH BEND, INDIANA, APPROVING <br />THE SALE OF PARK PROPERTY <br />STATEMENT OF PURPOSE AND INTENT <br />The City of South Bend, Indiana, for the use and benefit of its Park Department sncUor <br />Board of Park Commissioners (hereinafter, the "Park Department") owns certain real property <br />located adjacent to the former intersection of Calvert Street and hush Street, and being more <br />particularly described as follows: <br />A parcel of land being a part of the East Half of the Southwest. Quarter of Section <br />13, Towns`hi~~ 37 North, Range 2 East, City of South Bend, Portage Township; St. Joseph <br />County, Indiana and being more particularly described as follows: <br />Beginning at a corner of Lot 2 as the same is shown and designated on the plat of <br />Riley High School Minor Subdivision, the same being recorded as instn.iment number <br />9638147 in the office of the Recorder of St. Joseph County,: Indiana and being the . <br />intersection of the Southerly right-of way line of now. vacated Caivert.Street with the-East <br />right-of--way line of now vacated Rush Street; thence North 89°53' 15" East, along a <br />Southerly line of said Lot 2 and said Southerly right-of--way line, a distance of 8.89 feet to <br />a point of curvature; thence Southeasterly along a curee to the right delineating said <br />Southerly line of Lot 2 ,said curve having a radius of 379.26 feet, a central angle of <br />17°26'59" and limited in length by a chord of 115.06 feet that bears South 81°23'13" <br />East; thence South 54°30'00" West, a distance of 26.92 feet; thence South 37°00'00" <br />'Jest, a distance of 50.93 feet; thence South 19°00'00" West, a distance of 36.71 feet; <br />thence South 19°00'00" West, a distance of 36.71 feet; thence South 08°40'00" West, a <br />distance of 41.39 feet; thence South 03°30'00" East, a distance of 33.68 feet; thence <br />South 19°35'00" East, a distance of 80.53 feet; thence South 13°20'00" East, a distance <br />of 11.03 feet to a point on the Easterly projection of the North right-of--way line of now <br />vacated Bowman Street; thence South 89°52'51" West, along said Easterly projection, a <br />distance of 90.45 feet to its intersection with the East right-of--way line of now vacated <br />Rush Street; thence North O1°28'39" East, along said East right-of--way line and an East <br />line of said Lot 2, a distance of 269.65 feet to the place of beginning containing 0.457 <br />acres (19,892 square feet) more or less. <br />Subject to the legal rights of public highways, of any, and subject also to any <br />easements, covenants or restrictions of record. <br />
