r_ <br />Resolution No. 2019 on December 19, 2003; Expansion Area No. 19 by the adoption of <br />Resolution No. 2090 on October 22, 2004; Expansion Area No. 20 by the adoption of Resolution <br />No. 2144 on March 4, 2005; Expansion Area No. 21 by the adoption of Resolution No. 2254 on <br />August 25, 2006; and Expansion Area No. 22 by the adoption of Resolution No. 2279 on <br />December 15, 2006; and <br />WHEREAS, the Commission now desires to consolidate the Sample-Ewing Area <br />and the Sample-Ewing Allocation Area with and into the Airport Area and Allocation Area No. <br />1, respectively to form a consolidated area and a consolidated allocation area (the "Consolidated <br />Area"); and <br />WHEREAS, to accomplish this consolidation, the Commission desires to amend <br />the boundaries of the Airport Area to include the Sample-Ewing Area; and <br />WHEREAS, the Commission also desires to add certain parcels to the Airport <br />Area, such parcels being commonly referred to as the LaSalle Square Area (the "LaSalle Square <br />Area") and the Marycrest/Harwich Area (the "Marycrest/Harwich Area" and with the LaSalle <br />Square Area, the "Ne~~~ Areas"), as arc more particularly described in Exhibit C; and <br />WHEREAS, to accomplish this enlargement of the Airport Area, the Commission <br />desires to amend the boundaries of the Airport Area to include the New Areas. which shall be <br />labeled "Expansion Area No. 23" and "Expansion Area No. 24" for the LaSalle Square Area and <br />the Marycrest/Harwich Area, respectively; and <br />WHEREAS, the Commission previously adopted an economic development plan <br />for the Airport Area (the "Airport Area Development Plan"), and the Commission desires to <br />amend such plan to provide for the consolidation of the Sample-Ewing Area into the Airport <br />Area and to expand the Airport Area by including the New Areas as set forth in Exhibit D (the <br />"Plan Amendment"); and <br />WHEREAS, the Department, pursuant to the Act, has conducted surveys and <br />investigations and has thoroughly studied the Sample-Ewing Area, the New Areas and the <br />Airport Area within the City of South Bend, Indiana (the "City"); and <br />WHEREAS, upon such surveys, investigations and studies being made, the <br />Commission finds that the Plan Amendment, which Plan Amendment is attached hereto and is <br />hereinafter adopted in this Resolution, cannot be achieved by regulatory processes or by the <br />ordinary operations of private enterprise without resort to the powers allowed under the Act <br />because of lack of local public improvements and multiple ownership of land and that the public <br />health and welfare will be benefited by the accomplishment of the Plan Amendment, which shall <br />include the Sample-Ewing Area and the New Areas in the Airport Area; and <br />WHEREAS, the Commission has caused to be prepared maps and plats of the <br />Airport Area, the Sample-Ewing Area and the New Areas, said maps and plats of the Airport <br />• <br />BDDB01 47%224v4 - 2 - <br />
