RESOLUTION N0.2364 • RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION MAHING CERTAIN FINDINGS REGARDING PROPOSED MISHAWAKA AVENUE URBAN RENEWAL AREA WHEREAS, the South Bend Redevelopment Commission (the "Commission"), the governing body of the South Bend Department of Redevelopment (the "Department") and the Redevelopment District of the City of South Bend, Indiana (the "District"), exists and operates under the provisions of the Redevelopment of Cities and Towns Act of 1953, which has been codified in Indiana Code 36-7-14 et sea., as amended from time to time (the "Act"); and WHEREAS, the Commission, in accordance with the duties granted under authority of the Act, has conducted surveys, made investigations of areas needing redevelopment within the City of South Bend, Indiana (the "City") and of the causes contributing to the conditions of areas needing redevelopment as described at Indiana Code § 36-7-13; and WHEREAS, such investigations, studies and surveys have been made in cooperation with the various departments and bodies of the City and have been directed toward determining the proper use of land and improvements thereon so as to best serve the interests of the City and its residents; and WHEREAS, the Department has investigated, studied and surveyed that area within the City hereby designated as the "Mishawaka Avenue Urban Renewal Area", which area is more particularly described in Exhibit A attached hereto and incorporated herein; and WHEREAS, the Area consists of approximately /~~ acres and is contiguous and compact; and WHEREAS, as result of its investigations, studies and surveys, the Commission desires to make certain findings regarding the proposed Mishawaka Avenue Urban Renewal Area; NOW THEREFORE, BE IT RESOLVED by the South Bend Redevelopment Commission as follows: 1. The Commission hereby finds and determines that the area heretofore described as the Mishawaka Avenue Urban Renewal Area (the "Area") is an area needing redevelopment and specifically, that the Area is one in which normal development and occupancy are undesirable or impossible because of (1) lack of development; (2) cessation of growth; (3) deteriorated or deteriorating improvements; (4) character of occupancy; (5) age; (6) obsolescence; (7) substandard buildings; or (8) other factors that impair values or prevent a normal use or development of property. •
