RESOLUTION N0.2364 <br />• RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />MAHING CERTAIN FINDINGS REGARDING PROPOSED MISHAWAKA <br />AVENUE URBAN RENEWAL AREA <br />WHEREAS, the South Bend Redevelopment Commission (the "Commission"), <br />the governing body of the South Bend Department of Redevelopment (the "Department") and the <br />Redevelopment District of the City of South Bend, Indiana (the "District"), exists and operates <br />under the provisions of the Redevelopment of Cities and Towns Act of 1953, which has been <br />codified in Indiana Code 36-7-14 et sea., as amended from time to time (the "Act"); and <br />WHEREAS, the Commission, in accordance with the duties granted under <br />authority of the Act, has conducted surveys, made investigations of areas needing redevelopment <br />within the City of South Bend, Indiana (the "City") and of the causes contributing to the <br />conditions of areas needing redevelopment as described at Indiana Code § 36-7-13; and <br />WHEREAS, such investigations, studies and surveys have been made in <br />cooperation with the various departments and bodies of the City and have been directed toward <br />determining the proper use of land and improvements thereon so as to best serve the interests of <br />the City and its residents; and <br />WHEREAS, the Department has investigated, studied and surveyed that area <br />within the City hereby designated as the "Mishawaka Avenue Urban Renewal Area", which area <br />is more particularly described in Exhibit A attached hereto and incorporated herein; and <br />WHEREAS, the Area consists of approximately /~~ acres and is contiguous and <br />compact; and <br />WHEREAS, as result of its investigations, studies and surveys, the Commission <br />desires to make certain findings regarding the proposed Mishawaka Avenue Urban Renewal <br />Area; <br />NOW THEREFORE, BE IT RESOLVED by the South Bend Redevelopment <br />Commission as follows: <br />1. The Commission hereby finds and determines that the area heretofore <br />described as the Mishawaka Avenue Urban Renewal Area (the "Area") is an area needing <br />redevelopment and specifically, that the Area is one in which normal development and <br />occupancy are undesirable or impossible because of (1) lack of development; (2) cessation of <br />growth; (3) deteriorated or deteriorating improvements; (4) character of occupancy; (5) age; (6) <br />obsolescence; (7) substandard buildings; or (8) other factors that impair values or prevent a <br />normal use or development of property. <br />• <br />
