• WHEREAS, the Commission now desires to take final action determining the <br />public utility and benefit of the proposed acquisition, if any, and redevelopment of the Area and <br />confirming the Declaratory Resolution and the Plan Amendment, in accordance with <br />Section 17(d) of the Act; <br />NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment <br />Commission as follows: <br />1. After considering the evidence presented at the hearing on the 181h day of <br />July, 2008, the Commission hereby finds that the proposed Plan Amendment is reasonable and <br />appropriate when considered in relation to the Plan and the purposes of the Act. <br />2. The Commission hereby finds and determines that it will be of public <br />utility and benefit to proceed with the Plan, including the Plan Amendment, in the form approved <br />by the Commission in the Declaratory Resolution. <br />3. The Commission hereby finds that the Plan, with the proposed Plan <br />Amendment described herein, conforms to the comprehensive plan for the City. <br />4. The Declaratory Resolution and the Plan Amendment are hereby <br />confirmed. <br />5. The Plan is hereby amended to include the additional projects set forth and <br />described in the Plan Amendment attached hereto as Exhibit A, and the Plan, as so amended, is <br />• hereby approved in all respects. <br />6. This Resolution constitutes final action, pursuant to Indiana <br />Code 36-7-14-17(d), by the Commission determining the public utility and benefit of the <br />proposed projects and confirming the Declaratory Resolution and the Plan, including the Plan <br />Amendment, pertaining to the Area. <br />7.
