i <br />~~., ~~~~9a~' <br />• RESOLUTION N0.2467 <br />RESOLUTION OF THE SOUTH BEND REDEVELOPMENT <br />COMMISSION CONFIRMING A RESOLUTION OF THE SOUTH BEND <br />REDEVELOPMENT COMMISSION DESIGNATING AND DECLARING <br />AN AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE <br />SOUTH BEND CENTRAL DEVELOPMENT AREA <br />WHEREAS, on June 13, 2008, the South Bend Redevelopment Commission (the <br />"Commission") approved and adopted its Resolution No. 2458 entitled "Resolution of the City of <br />South Bend, Indiana, Redevelopment Commission Designating and Declaring an Amendment to <br />the Redevelopment Plan for the South Bend Central Development Area" (the "Declaratory <br />Resolution"); and <br />WHEREAS, the Declaratory Resolution approved an amendment (the "Plan <br />Amendment") to incorporate the East Bank Village Master Plan - Phase I into the redevelopment <br />plan (the "Original Plan") for the South Bend Central Development Area (the "Area"), (the <br />Original Plan, as amended by the Plan Amendment, shall hereinafter be referred to as the <br />"Plan"); and <br />• WHEREAS, on June 17, 2008, pursuant to Section 16(a) of the Act, the St. <br />Joseph County Area Plan Commission (the "Plan Commission") adopted a resolution <br />constituting its written order approving the Declaratory Resolution and the Plan, including the <br />Plan Amendment (the "Plan Commission Order"); and <br />WHEREAS, on June 23, 2008, pursuant to Section 16(b) of the Act, the Common <br />Council of the City (the "Common Council") adopted its Resolution No. 3879-08, which <br />approved the Plan Commission Order; and <br />WHEREAS, the Commission caused to be published and delivered the notices <br />required by the Act concerning the Declaratory Resolution and the Plan Amendment; and <br />WHEREAS, at the hearing held by the Commission on the 18'" day of July, 2008, <br />at 10:00 a.m. (local time), at the County-City Building, Room 1308, 227 West Jefferson <br />Boulevard, South Bend, Indiana, the Commission heard all persons interested in the proceedings <br />and considered written remonstrances and objections filed, if any, and such other evidence <br />presented; and <br />WHEREAS, the Declaratory Resolution and the Plan Amendment do not enlarge <br />the boundaries of the Area; and <br />u <br />BDDBOI 5321434v1 <br />
