RESOLUTION N0.2453 . A RESOLUTION OF THE SOUTH B R y~NEEDED FOR REDEVELOPM E T RELATED TO THE GIFT OF PROPE IN THE SOUTH BEND CENTRAL DEVELOPMENT AREA WHEREAS, under the authority granted by Indiana Code § 36-7-14, et seq. and in furtherance of the South Bend Central Development Area Plan ("Plan"), the South Bend Redevelopment Commission ("Commission") has determined it is necessary to acquire unencumbered fee simple interests in certain properties located within the area heretofore designated as the South Bend Central Development Area (the "Area") within the City of South Bend, Indiana (the "City"); and WHEREAS, Center City Housing, an Indiana Limited Partnership ("Donor") wishes to donate certain property located at 332 West Jefferson, South Bend, Indiana 46617 located in the County of St. Joseph, State of Indiana, and more particularly described as follows: Beginning at a point Three (3) rods East of the Northeast corner of Lot Numbered One (1) in Block Numbered Four (4) in Vail's Addition to the Town, now City of South Bend, thence running East Thirty-four (34) feet; thence South One Hundred Ninety-eight (198) feet to the North line of a public alley; thence West Thirty-four (34) feet; thence North One Hundred Ninety-eight (198) feet to the place of beginning and being Lot Numbered Two (2) as shown on the survey of the Johnson Two Acres in the City of South Bend, a plat of which is recorded in Plat • Book Numbered 1, page 65, of the records of said County (the "Properties"). WHEREAS, the Commission pursuant to 36-7-14-12.2(a) may acquire by gift any interest in real property needed for the redevelopment of areas needing redevelopment that are located within the corporate boundaries of the City; and WHEREAS, the Commission has determined the Property is needed for the redevelopment of the Area; and WHEREAS, I.C. 36-7-14-19(e) authorizes the Commission without the necessity of the requirements of LC. 36-7-14-19(b) including but not limited to, adding the Property on the acquisition list, obtaining two (2) independent appraisals of fair market value and other such requirements contained in the Indiana Code so long as the Property is free and clear of all liens other than taxes, assessments, and other governmental charges; and WHEREAS, a title search of the Property has revealed the Property is free and clear of all liens other than taxes, assessments, and other governmental charges; and WHEREAS, the Commission finds all procedures necessary for accepting a gift of the Property have been completed in accordance with Indiana law; •
