PUBLIC AGENDA SESSION MAY 21, 2009 163 <br />South Bend, Indiana (Miami Road Widening Project; DES # 931900)" which the Board modifi <br />and confirmed its intent and desire to acquire temporary right-of-way oif'parcels as set forth <br />Exhibits "A] — El " and more particularly described in Exhibit A2 — E2 " ("Temporary ROI <br />Prq% each Exhibit bein • attached hereto and incoi-yorated henvAin-aga <br />as to all persons; and <br />WHEREAS, Resolution No. 30-2009, further directed the Staff to prepare a list of all the <br />property owners or holders of the Temporary ROW Property, and of interests in it, sought to be <br />acquired or to be injuriously affected • the resolution and to file such list with the Board for <br />further consideration as to the damages, if any, and the benefits, if any, resulting to such owners <br />or holders by reason of the appropriation as by law provided; and <br />WHEREAS, the Board has considered the Staff s report and the appraisals, and finds that <br />the amount • damages • indicated should be paid to the various owners of the Temporary <br />ROW Property on account of the Board's acquisition of the Temporary ROW Property; and <br />NOW, THEREFORE, BE IT RESOLVED, by the City of South Bend, Indiana, Board of <br />Public Works, as follows: <br />1. The Board now awards damages to the Owner of the Temporary ROW Prope <br />in the amounts specified on account of the Board's acquisition of thle RO <br />Property situated in St. Joseph County, State of Indiana, as set forth in Exhib <br />and more particularly described in Exhibit "A2 — E2 " to-wit: <br />3. Persons disagreeing with the awards made herein must file a remonstrance in <br />writing on or before June 8, 2009. <br />4.
