Staff Report <br />APC # 2487-08 <br />Owner: Douglas Road Partners, L.P. <br />Location: 3454 Douglas Road <br />Jurisdiction: City of South Bend <br />Requested Action: <br />The petitioner is requesting a zone change from CB Community Business District to CB <br />Community Business District to allow Permitted uses allowed in CB Community Business <br />District, excepting those within the written commitments. <br />Land Uses and Zonin g: <br />On site: On site is Brown Mackie College, currently under construction. <br />North: To the north is Memorial Home Care zoned CB Community Business District. <br />East: To the east is a dance school zoned LB Local Business. <br />South: To the south are homes zoned R Single Family District (County). <br />West: To the west aze single family homes zoned R Single Family District (County). <br />District uses and development standards: <br />The CB -Community Business District is established to provide a location for high volume and <br />high intensity commercial uses. Activities in this district are often large space users which may <br />include limited amounts of outdoor sales or outdoor-operations. Developments within the CB <br />District shall be coordinated to facilitate vehiculaz and pedestrian access from neazby residential <br />districts. <br />Site plan description: <br />The total site is 12.13 acres. The site plan shows a 46,008 square foot office building, which is <br />currently under construction, and 479 pazking spaces. Improvements will cover 38.3% of the lot. <br />An additional 77 pazking spaces have been set aside for the future. The remaining open space <br />will be 61.7% of the site. <br />Zoning and land use history & trends: <br />The portion of the site currently zoned CB Community Business District was rezoned from SF1 <br />Single Family and Two Family District and OB Office Buffer District in September of 2005. <br />In October 2007 a petition similaz to the current one was approved subject to written <br />- commitments. The written commitments were approved in December 2008. <br />Traffic and transportation considerations: <br />Douglas Road is currently two lanes and is currently being widened to four lanes. <br />Utilities: <br />The site will be serviced by municipal water and sewer. <br />Additional information: (Agency comments) <br />According to the FIRM Maps by FEMA, the southern part of this site, which is part of the <br />proposed parking lot, is located in the floodplain. The Wetland Inventory Maps indicate there are <br />wetlands in the southwest comer of the site. <br />Commitments: <br />There aze two differences between the commitments which were passed in December 2008 and <br />the commitments submitted with the current petition.
