A RESOLUTION OF THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA,
APPROVING A PETITION OF THE SOUTH BEND
BOARD OF ZONING APPEALS
FOR THE PROPERTY LOCATED AT
721 N. COLLEGE, SOUTH BEND, INDIANA 46619
WHEREAS, Indiana Code Section 36-7-4-918.6, requires the Common Council to give
notice pursuant to Indiana Code Section 5-14-1.5-5, of its intention to consider Petitions from the
Board of Zoning Appeals for approval or disapproval; and
WHEREAS, the Common Council must take action within sixty (60) days after the Board
of Zoning Appeals makes its recommendation to the Council; and
WHEREAS, the Common Council is required to make a determination in writing on such
requests pursuant to Indiana Code Section 36-7-4-918.4, and
WHEREAS, the South Bend Board of Zoning Appeals has made a recommendation,
pursuant to applicable state law.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA as follows:
SECTION I. The Common Council has provided notice of the hearing on the Petition from the
Board of Zoning Appeals pursuant to Indiana Code Section 5-14-1.5.5, requesting that a Special
Exception be granted for the property located at:
721 N. College, South Bend, Indiana 46619
in order to permit the construction of a 195' wireless telecommunications tower.
SECTION II. Following a presentation by the Petitioner, and after proper public hearing, the
Common Council herby approves the petition of the South Bend Board of Zoning Appeals, a
copy of which is on file in the Office of the City Clerk.

SECTION III. The Common Council of the City of South Bend, Indiana hereby fords that:
1. The proposed use will not be injurious to the public health, safety, comfort,
community moral standards, convenience or general welfare;
2. The proposed use will not injure or adversely affect the use of the adjacent area
or property values therein;
3. The proposed use will be consistent with the character of the district in which it is
located and the land uses authorized therein; and
4. T'he proposed use is compatible with the recommendations of the City of
South Bend Comprehensive plan.
SECTION IV. Approval is subject to the Petitioner complying with the reasonable conditions
established by the Board of Zoning Appeals which are on file in the office of the City Clerk.
SECTION V. The Resolution shall be in full force and effect from and after its adoption by the
Common Council and approval by the Mayor.

NATURE OF APPEAL, VARIANCE, OR SPECIAL EXCEPTION: Horvath
Communications, Inc. seeks a Special Exception to conshuct a wireless telecommunications
tower and facility. The proposed sit is located in Portage Township in South Bend. The
proposal is fora 195' Monopole capable of co-locating 4 wireless carriers and providing_free
mace to law enforcement and public safety agencies. The initial cellular provide to locate on
the tower will be Sprint. Sprint requires a new tower because no existing towers or structures
are located within the geographic area that meet Sprint's technical requirements to provide
service to the specific geographic area affected by a g_ap in Sprint's coverage.

STANDARDS FOR SPECIAL EXCEPTIONS I.C. 36-7-4-918.4
(1) The proposed use will not be injurious to the public health, safety, comfort,
community moral standards, convenience or general welfare;
The proposed telecommunications tower would make no sounds, emit no odors,
or generate any additional traffic in the area. The site would be uninhabited, and its
installation would not change drainage patterns, or require sewer of water utilities.
The proposed tower will improve public safety by providing space on the tower
for public safety and law enforcement use, and improve the access and reliability of
cellulaz phone coverage (including 911) in the azea.
(2) The proposed use will not injure or adversely affect the use of the adjacent area
or property values therein;
New telecommunications towers aze permitted Special Exceptions in Light
Industrial districts. The proposed tower will not adversely affect or disrupt the
adjoining properties in any manner. It will only disturb an 81' by 110' leased parcel of
land on a commercial property.
(3) The proposed use will be consistent with the character of the district in which it is
located and the land uses authorized therein; and,
The district is zoned Light Industrial. The proposed site is a vacant parcel on a
commercial property that is adjacent to properties that are classified and being used either
for commercial or industrial purposes.
(4) The proposed use is compatible with the recommendations of the City of South
Bend Comprehensive plan.
The proposed tower would facilitate wireless telecommunications services to the
residents and business of South Bend. The proposed tower will comply with South
Bend's tower development standards, and it will be constructed to co-locate four wireless
communications providers thereby reducing the need for additional towers in the azea.

Horvath Communications Co-Location Policy
It is the policy of Horvath Communications to co-locate any viable BB or BBE* carrier
on our tower sites within the confines of the structural capabilities of the tower based
upon engineered design of both the tower and the foundation. Typically, Horvath towers
are originally structured for 4 (four) carriers, however, 5 (five) and 6 (six) carver towers
are options. Horvath Communications' telecommunications towers are available for use
by wireless telecommunications providers on a reasonable and non-discriminatory basis
at a cost not exceeding the fair market value for the use of the facility.
When economically feasible, Horvath will also co-locate additional carriers by
structurally enhancing 3 (three) and 4 (four) carrier towers to accept the additional
loading of fourth, fifth and sixth carriers.
Horvath Communications accepts and encourages co-location applications from all
interested parties, including, but not limited to: municipalities, public safety entities,
schools, wireless Internet companies and BB /BBE* companies.

Concerned parties,
iPCS/Bright Communi~tions Services, LLC is interested in building a tower for the purpose of providing
personal communications services to its customers in South Bend, Indiana. Specifically, the area centering
on Linrnln Way West between N. Olive Street and Diamond Avenue in South Bend, Indiana.
The proposed site will:
1) Most importantly, provide wverage in areas where there is .poor to no iPCS mobile phone
coverage. Customers may experience dropped calls along Lincoln Way West and surrounding
areas southeast of the South Bend Regional Airport
2) Provide needed in-building and in-home coverage to customers in this area.
3) Provide needed capacity relief to existing on-air iPCS tower sites in the area, particularly
those just west of the Notre Dame campus. iPCS is in a unique and undesirable situation in
the South Bend area, in that our broadband spectrum is limited to 10 MHz. A typical iPCS
market will have double or triple that capacity, i.e. ZO-30 MHz.
What this means is that in areas of high mobile phone and mobile data usage surrounding
Notre Dame Campus, iPCS must seek to locate additional tower sites. Choosing not to locate
additional tower sites in this situation will result in mobile phones going "out of service" and
dropped calls, or inability to place calls, on a large scale. Surrounding tower sites can go "out
of service" as they attempt to absorb the additional load on the network and become
overloaded themselves. This opens up "coverage holes" in our network where users are
unable to locate service and use their mobile phones.
iPCS first attempts to locate on existing tower structures for new antenna sites. There is an existing
Global Signal tower site near this area. However, the Global Signal tower is approximately 1.2 miles
from the center of the area we are attempting to provide coverage to. In addition, the available height
to locate our equipment on the Global Signal tower is 25' lower than what would be available on the
proposed Horvath tower; this is a significant height reduction. There is also an existing Charlie Hayes
tower near this area. However, the Hayes tower is approximately 1 mile from the center of the area we
are attempting to provide coverage to. In addition, the available height to locate our equipment on the
Hayes tower is 45' lower than what would be available on the proposed Horvath tower. These factors
combined make the Global Signal and Hayes towers unacceptable to accomplish our coverage goal for
this area, which is evidenced by the signal strength maps of the area that accompany this letter.
When it became apparent that there were no other existing structures of suitable height in the area,
iPCS contracted Horvath to find a suitable location to build a new tower.
