Secretary of the Interior take title to the Site in trust for the <br />PokagQn Band of Potawatomi Indians, Michigan and Indiana; <br />and <br />WHEREAS: The Pokagon Band's and the Authority's plans and <br />foreseeable development for the Site include a tribal village with <br />44 housing units and a multi-purpose facility with health service. <br />and other tribal government facilities and, in accordance with <br />Pokagon Band, law and the Indian Gaming Regulatory Act of <br />1988,P.L. 100-497, 25 U.S.C. § 2701 et seq., planned and <br />foreseeable development of the Site also includes a casino <br />gaming facility; and <br />WHEREAS: Pokagon Band and Authority representatives have been <br />negotiating with City representatives concerning the terms of a <br />local agreement (the "Local Agreement") to address matters of <br />mutual concern regarding the Site and planned and foreseeable <br />development for the Site; and <br />WHEREAS: The purpose of the Local Agreement is to establish and <br />memorialize the various and beneficial commitments that the <br />Pokagon Band, the Authority, and the City have made to each <br />other out of recognition and respect for the sovereignty and <br />mutual best interests of each party; and <br />WHEREAS: The Authority Board of Directors ("Board") has reviewed ed the <br />Local Agreement and has concluded that the Local Agreement <br />is in the best interests of the Authority and will further the <br />Authority's long term interests and objectives. <br />NOW, THEREFORE, BE IT RESOLVED that the Board approves the Local <br />Agreement attached hereto and made a part of the record of this Board <br />session and authorizes the President/CEO and the Board Secretary to <br />execute the Local Agreement, substantially identical to the attached Local <br />Agreement, on behalf of the Authority; and <br />BE IT FURTHER RESOLVED that, as provided in Section 17 of the Local <br />Agreement and subject to all conditions and limitations stated therein, the <br />Board agrees to participate in any Mediation process and any Arbitration <br />procedure commenced under the Local Agreement; and <br />
