An irregular parcel of land in the N.W. 1 of <br /> Section 18, Township 37niNorth, Range 3 East, in the <br /> City of South Bend, St. Joseph County, Indiana, being <br /> all of the tract of land lying between the center line <br /> of North Shore Boulevard and the low water line of the <br /> St. Joseph River, 200 feet in width, located 100 feet <br /> on either side of the center line of the proposed new <br /> right of way of the Grand Trunk Railway and measured <br /> at right angles therefrom; said center line being located <br /> and described as followss <br /> Beginning on the Southerly line of Mishawaka <br /> Avenue, as platted and laid out in the Northwest Quarter <br /> (1/4) of Section 3ighteen i8), Township Thirty-seven <br /> (37) North, Range Three (31 East, in the City od South <br /> Bend, in said County, at a point Nine Hundred and 'Fifty- <br /> I one Hundredths (900.51) feet from the intersection of <br /> the east line of Eddy Street with the Southerly line of <br /> Mishawaka Avenue, which point is One Hundred Fifty-five <br /> and Fifty-one Hundredths (155.51) feet easterly from the <br /> Northeast corner of hot Numbered Fourteen (14) in the Re- <br /> plat of Beyer's Second Addition to the City of South Bend, <br /> as recorded in Plat Book 12 at Page 24 of the records of <br /> said county, all measurements to be made along the southerly <br /> line of said Mishawaka Avenueā€˛ thence South Fifty-three <br /> (53) degrees eighteen (18) minutes west (making an angle of <br /> seventy (70) degrees forty-six (46) minutes with the <br /> southerly line of said Mishawaka Avenue) to the St. Joseph <br /> River, <br /> which real estate is owned by said City for park purposes; and <br /> WHEREAS, the Board of Park Commissioners of said City <br /> have, after due and proper deliberation, resolved that said real <br /> estate should be sold and have duly requested this Council to pass <br /> an Ordinahee authorizing and directing said Park Board to sell said <br /> real estate as provided by law and has prepared and 'submitted this <br /> Ordinance for the consideration of this Council, which sale or sales <br /> of said tracts shall be made for not less than the fair cash value <br /> as fixed by three (3) disinterested freeholders of said City, who <br /> shall be appointed by the Judge of the St. Joseph Circuit Court of <br /> St. Joseph County, Indiana. <br /> SECTION 2. <br /> That the proceeds of such sale, or sales, shall be credited <br /> to the Department of Public Parks and expended in the improvement of <br /> the remaining park lands in the City of South Bend, Indiana, or in <br /> the purchase of other lands for park purposes for the said City of <br /> South Bend, as the said Board of Park Commissioners may deem for the <br /> best interests of said city. <br /> SECTION 3. <br /> - 2 - <br />
