REGULAR MEETING SEPTEMBER 8. 2015 298 WHEREAS, the City of South Bend, In, Board of Public Works (the `Board") has custody of and may maintain and dispose of certain real property owned by the City of South Bend, Indiana (the `City") pursuant to I.C. 36-9-6-3; and WHEREAS, the City is the owner of a certain parcel of real property particularly described. in Exhibit "A" ("Land"); WHEREAS, IIabitat for Humanity of St. Joseph County ("Habitat') is an Indiana non- profit domestic corporation which is organized expand the supply or sustain the existing supply of good quality, affordable housing for residents of Indiana having low or moderate incomes; and WHEREAS, Habitat desires to take ownership of the Land in furtherance of its efforts to offer affordable, good quality housing to low or moderate income residents; and WHEREAS, the City has determined that it no longer requires the use of said Land; and WHEREAS, the City, pursuant to I.C. 36-1-11 -1 (b)(20) may transfer property, without consideration, to an Indiana non-profit corporation organized for the purpose of expanding the supply or sustaining the existing supply of good quality, affordable housing for residents of Indiana having low or moderate incomes; and WHEREAS, the Board wishes to transfer the Land to Habitat; and WHEREAS, Habitat wishes to accept the transfer of the Land from the City. NOW, THEREFORE, BE IT RESOLVED BY THE, BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: 1. The Board, acting upon the authority granted to it under I.C. 36-1-11-1(b)(20), hereby transfer the Land to Habitat for no consideration. 2. This Resolution shall be in full force and effect upon its adoption by the Board.
