ORDINANCE N0. 2 q 3 S' <br />AN ORDINANCE RELATING TO 'M PROTECTION OF THE RIGHT <br />OF WAY OF THE GRAND TRUNK WESTERN RAILROAD COBTPANY <br />OVER CERTAIN STREETS IN THE CITY OF SOUTH BEND, INDIANa. <br />WHEREAS, heretofore, there was duly enacted Ordinance <br />No. 2736 of the City of South Bend, Indiana, entitled: "An Ordinance <br />Relating to the Protection of the Right of Way of the Grand Trunk <br />Western Railroad Company and the Kankakee Division of the New York <br />Central Railroad Company over Certain Streets of the City of South Bend, <br />Indiana. which Ordinance in part provided for the protection of the inter- <br />sections of the Right of way of the Grand Trunk Western Railroad Company <br />with Carroll Street, Columbia Street, Fellows Street, St. Joseph Street <br />and Lincolnway East, all public streets in said City of South Bend, Indianaā€˛ <br />WHEREAS, since the enactment of said Ordinance, the course of <br />the main line of said Grand Trunk Western Railroad Company has been changed <br />from Greenlawn Avenue westward in said City of South Bend, so that the said <br />main line now follows a new southwesterly course from said Greenlawn Avenue. <br />WEffRF&R, that portion of the Right of way of said Grand <br />Trunk Western Railroad Company which lies between Greenlawn Avenue and <br />Michigan Street in said City of South Bend, Indiana, and which was at the <br />time of the enactment of said Ordinance a part of the main line of said <br />Railroad Company, has now become an industrial siding with very few switching <br />movements thereover daily. <br />WHEREAS, said Grand Trunk Western Railroad Company is now <br />protecting the intersection of its Right of Way with said named streets with <br />manually operated mechanical flashlights at Carroll Street, Columbia Street, <br />Fellows Street and Lincoinway East between the hours of 6 A.M. and 6 P.M. each <br />day, and by requiring all switching movements over each and all of said inter- <br />sections by day or night, that are not headed by an engine,to be protected by <br />a member of the crew stationed conspicuously on the crossings. <br />WHEREAS, this Council is of the opinion that said flashlights, <br />as placed and now operated, supplemented by the protection given by members <br />
