RESOLUTION NO. <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br />AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR HAZARDOUS MATERIAL <br />INCIDENT RESPONSE SERVICES BETWEEN THE CITY OF SOUTH BEND <br />AND THE INDIANA DEPARTMENT OF HIGHWAYS <br />WHEREAS, the Common Council of the City of South Bend <br />recognizes the existence of the South Bend Fire Department <br />Hazardous Materials Incident Response Team consisting of trained <br />personnel and equipment for response to hazardous materials <br />incidents; and <br />WHEREAS, because of continued increase in vehicular traffic <br />transporting hazardous materials on the Toll Road, the Indiana <br />Department of Highways wishes to continue to receive the services <br />of the South Bend Fire Department Hazardous Materials Incident <br />Response Team for response, assessment and control of hazardous <br />materials incidents occurring within its jurisdiction; and <br />WHEREAS, I.C. 37 -1 -7 -1 et seq. permits governmental entities <br />to exercise powers jointly by entering into a written agreement; <br />and <br />WHEREAS, on the Board of Public Safety <br />reviewed this request of the Indiana Department of Highways and <br />recommends that the Common Council approve the renewal of an <br />Agreement for Hazardous Materials Incident Response Services with <br />the Indiana Department of Highways, Toll Road Division. <br />NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the <br />City of South Bend, Indiana, as follows: <br />SECTION I. That the Common <br />renew the Agreement with the <br />Hazardous Materials Incident <br />be authorized to execute the <br />carry out the request of the <br />intent of this resolution. <br />-ouncil of the City of South Bend <br />Indiana Department of Highways for <br />Response Services and the Mayor <br />appropriate Agreement necessary to <br />Indiana Department of Highways and <br />SECTION II.
