RESOLUTION NO. 1723 -89 <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br />AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR HAZARDOUS <br />MATERIAL INCIDENT RESPONSE SERVICES BETWEEN)THE CITY <br />OF SOUTH BEND AND THE INDIANA DEPARTMENT OF HIGHWAYS <br />WHEREAS, the Common Council of the City of-South Bend recognizes <br />the existence of the South Bend Fire Department Hazardous <br />Materials Incident Response Team consisting of tzained personnel <br />and equipment for response to hazardous materials incidents; and <br />WHEREAS, because of continued increase in vehicular traffic <br />transporting hazardous materials on the Toll Road, the Indiana <br />Department of Highways wishes to continue to receive the <br />services of the South Bend Fire Department Hazardous Materials <br />Incident Response Team for response, assessment and control of <br />hazardous materials incidents occurring within its jurisdiction; <br />and <br />WHEREAS, I.C. 37 -1 -7 -1 et seq. permits governmental entities to <br />exercise powers jointly by entering into a written agreement; <br />and <br />WHEREAS, the Board of Public Safety reviewed this request of the <br />Indiana Department of Highways and recommends that the Common <br />Council approve the renewal of an Agreement for Hazardous <br />Materials Incident Response Services with the Indiana Department <br />of Highways, Toll Road Division. <br />NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the <br />City of South Bend, Indiana, as follows: <br />SECTION I. That the Common Council of the City of South Bend <br />renew the Agreement with the Indiana Department of Highways for <br />Hazardous Materials Incident Response Services and the Mayor be <br />authorized to execute the appropriate Agreement necessary to <br />carry out the request of the Indiana Department of Highways and <br />intent of this resolution. <br />SECTION II.
