Approving the Transfer of Certain Real Estate by the South Bend Board of Park Commissionsers to South Bend Redevelopment Authority

.A RESOLUTION NO. A RESOLUTION OF THE SOUTH BEND BOARD OF PARK COMMISSIONERS INDICATING ITS INTENTION TO TRANSFER CERTAIN REAL ESTATE TO THE SOUTH BEND REDEVELOPMENT AUTHORITY WHEREAS, the South Bend Board of Park Commissioners is the owner of Howard Park, Viewing Park, the West Riverbank walkway near the Century Center, all of which are within the South Bend Redevelopment Commission's South Bend Central Development Area; and, WHEREAS, the Board of Public Works of the City of South Bend is the owner of the Morris Civic Auditorium Park, which property is and has been operated and controlled, with the consent of the Board of Public works, by the South Bend Board of Park Commissioners for Park purposes, and which property is within the South Bend Redevelopment Commission's South Bend Central Development Area; and, WHEREAS, the sea wall and walkway within Howard Park, the entire area comprising Viewing Park, the West Riverbank walkway near Century Center and the Morris Civic Auditorium Park are in need of public improvements; and, WHEREAS, pursuant to I.C. 36 -7 -14 -25.2 and I.C. 36 -7- 14.5 -14 the South Bend Redevelopment Commission has entered into a lease agreement with the South Bend Redevelopment Authority for the financing and construction of public improvements within the South Bend Central Development Area, including the improvements to Howard Park sea wall and walkway, Viewing Park, the West Riverbank walkway near Century Center and the Morris Civic Auditorium Park; and, WHEREAS, pursuant to I.C. 36 -7- 14.5 -19 the South Bend Redevelopment Authority is authorized to issue bonds in order to finance public improvements in the South Bend Central Development Area as set forth in I.C. 36 -7- 14.5 -11 and the Authority intends to issue such bonds for public improvements in the South Bend Central Redevelopment Area; and, WHEREAS, I.C. 36 -7- 14.5 -11 requires that the South Bend Redevelopment Authority hold title to the real estate and the public improvements to be made thereon by the South Bend Redevelopment Authority pursuant to I.C. 36 -7 -14.5; and WHEREAS, pursuant to I.C. 36- 10- 4 -9(8) the Board of Park Commissioners may transfer title to Park property to another entity of the City; and, WHEREAS, parcels of land hereunder transferred by the Board of Park Commissioners to the South Bend Redevelopment Authority for public improvement will continue to be used for Park purposes and it is not necessary for the Board of Park Commissioners to hold title to said real estate in order to continue such use; and WHEREAS, the Board of Park Commissioners desires to transfer the Howard Park sea wall and walkway, the parcels of land comprising Viewing Park, the West Riverbank walkway near the Century Center, and the Board of Public Works and Board of Park Commissioners desire to transfer the Morris Civic Auditorium Park, all of which properties are more fully described in Exhibits A, B, C and D attached hereto and made a part hereof, to the South Bend Redevelopment Authority so that the Authority can make public improvements thereon under the lease with the South Bend Redevelopment Commission and pursuant to I.C. 36 -7- 14.5 -11; and WHEREAS, pursuant to I.C. 36- 1 -11 -3 the Board of Park Commissioners has been designated by the Mayor as the entity to hold a public hearing on the transfer of said Park property and the Morris Civic Auditorium Park, and the Board of Park Commissioners has published notice pursuant to I.C. 5 -3 -1 of its public hearing held this date; and
