<br />ORDINANCE NO. 204-6
<br />BE IT ORDAINED by the Common Council of the City of South Bend,
<br />Indiana.
<br />SECTION 1. It shall be unlawful for any person, firm or corporation
<br />to give, conduct, keep, allow and /or maintain any form of entertain-
<br />ment, amusement and /or exhibition at, in or in connection with any
<br />restaurant, public eating place and /or club.within the City of South
<br />Bend, without first having obtained a license therefor from the Con -
<br />troller of the City of South Bend. This section shall not apply to
<br />the use of a radio and /or phonograph in such place, or places, unless
<br />there be dancing to the music furnished by such instruments.
<br />SECTION 2_ It shall be unlawful for any person, firm or corporation
<br />to give, conduct, keep, allow and/or maintain any form of entertain-
<br />ment, amusement and /or exhibition at, in or in connection with any
<br />restaurant, public eating place and/or Club where beer and /or in-
<br />toxicating liquors are sold for consumption on the premises in the
<br />City of South Bend, without first having obtained a license therefor
<br />from the Controller of the City of South Bend. This section shall
<br />not apply to the use of a radio and/or phonograph in such place, or
<br />places, unless there be dancing to the music furnished by such in-
<br />struments.
<br />SECTION 3. It shall be unlawful for any person, firm or corporation
<br />to give, conduct, keep, allow and /or maintain any form of entertain-
<br />ment, amusement and /or exhibition at, in or in connection with any
<br />restaurant, public eating place and/or club, where intoxicating
<br />liquors are sold for consumption on the premises, at any point beyond,
<br />but within four (4), miles of the limits of the City of South Bend,
<br />without first having obtained a license therefor from the Controller
<br />of the City of South Bend, Indiana. This section shall not apply to
<br />any point within the corporate limits of another municipal corpora-
<br />tion. This section shall also not apply to the use of a radio and /or
<br />phonograph in such place, or places, unless there be dancing to the
<br />music furnished by such instruments.
<br />SECTION 4. Any person, firm or corporation desiring to give, con-
<br />duct, keep, allow and/or maintain any form of entertainment, amuse-
<br />ment and /or exhibitions at, in, or in connection with any restaurant,
<br />public eating place and/or club as in Sections 1 and 2 of this
<br />Ordinance provided shall first file his, their or its application
<br />for a license therefor with the Controller of the City of South Bend,
<br />Indiana, which application shall state his, their or its name, the
<br />proposed place of business, the character and nature of the thing,
<br />or things, to be done and /or the entertainment, amusement and /or
<br />exhibition proposed to be given and with said application shall
<br />deposit a receipt from the City Treasurer, which receipt shall show
<br />that the applicant has paid to such Treasurer the sum hereinafter
<br />fixed to be paid for such license.
<br />The Controller may refuse to grant any such license when
<br />he has reasonable cause to believe that the things proposed to be
<br />done thereunder will be in violation of this Ordinance and /or any
<br />Ordinance of this City, or law of the State of Indiana.
