Section II. Chapter 17, Article 7, Section 17 -57 shall be amended to add a new sub -part <br />(c) which shall read in its entirety as follows: <br />See. 17 -57. Definitions. <br />(c) Residential shall mean single family dwelling units and dwellings containing up to a <br />maximum of four separate living quarters occupied or intended to be occupied by no more than <br />four (4) families living independently of each other. <br />Section III. Chapter 17, Article 7, Section 17 -58 of the South Bend Municipal Code be <br />and hereby is amended to read in its entirety as follows: <br />Sec.17 -58. Application of funds. <br />Funds collected under this article shall be used for the payment of all costs in excess of <br />€rye two hundred fifty dollars ($59250.00) which the City declares to be directly attributable to the <br />repair of a private sewer service. Said costs shall ne -- include any reasonable charges associated <br />with the removal or replacement of any trees, shrubbery, plants, lawns, sprinkler systems, or ether <br />similar landscaping features on public or private property; and shall also include :et be °'ale <br />fer- arr}zreasonable expenses incurred in tunneling under and/or replacing axy in similar condition <br />hard surface improvements such as bituminous, concrete, or brick driveways, patios, sprinkler <br />systems, gas rills utility line foundations, ' <br />g ,and any other- similar surface or subsurface <br />improvements found on public or private property. Said costs shall also include charges associated <br />with the removal and/or replacement of public streets, curbs and walks. Excluded from covered <br />costs are expenses for utility lines and foundations which shall be the sole responsibility of the <br />property owner. Any replacement or repair under this Section shall be subiect to a total cost limit <br />of one thousand dollars ($1,000.00). Repair or replacement of any landscaping hard surface or <br />other improvement directly attributable to the sewer repair which is in excess of the limit set for <br />such improvements shall be the property owner's sole responsibility and expense The City shall <br />determine whether the repair or replacement should be done by its employees or by other <br />contractors. <br />Section IV. Chapter 17, Article 7, Section 17 -60 of the South Bend Municipal Code be <br />and hereby is amended to read in its entirety as follows: <br />Sec.17 -60. Charges to private sewer owner; payment. <br />(a) The owner of the private residential sewer shall be responsible to pay to the City of <br />South Bend the first €rye two hundred fifty dollars ($39250.00) of cost incurred for all work as <br />allowed under section 17 -58, Application of funds. <br />(b) Payment shall be due the City of South Bend within three R ;died rx� (345-5) <br />days six months of date of invoice by the Controller of the City of South Bend. Failure to pay as <br />required herein shall constitute a lien upon the property in favor of the City of South Bend. <br />Section V. Chapter 17, Article 7, Section 17 -63 of the South Bend Municipal Code shall <br />be amended to read in its entirety as follows: <br />
