Substitute Bill No. 2q-15 <br />ORDINANCE NO. <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AMENDING VARIOUS SECTIONS OF CHAPTER 17, ARTICLE 7, OF THE <br />SOUTH BEND MUNICIPAL CODE TO DECREASE THE SEWER INSURANCE <br />PROGRAM DEDUCTIBLE <br />AND TO MAKE OTHER PROGRAM CHANGES <br />STATEMENT OF PURPOSE AND INTENT <br />The City of South Bend (the City) implemented a program for repair of residential utility <br />customer sewer lines in 1980 (Ordinance No. 6830 -80). This Program covers sewer line breaks <br />and damage unrelated to poor maintenance. Around 2010 certain administrative changes were <br />implemented resulting in greater control of the sewer insurance Program's operating costs. After <br />several years of operating the sewer insurance Program under the new policies which have reduced <br />overall costs, it is appropriate to amend the South Bend Municipal Code to better serve sewer <br />insurance customers and decrease their portion of program expenses. <br />The average cost to the City of a full residential sewer line repair is around $7,000.00 of <br />which the customer is responsible for $500.00 of such cost. This ordinance will reduce the <br />customer cost to $250.00. It also provides for replacement in like- condition of the customer's <br />landscaping and hard surface improvements, as well as sprinkler system repair or replacement, <br />each and all up to a maximum dollar limit of one thousand dollars ($1,000). Such improvements <br />were previously the customer's sole responsibility under the Program. This Ordinance enacts the <br />Municipal Code Amendments necessary to make these changes, and it further clarifies the <br />residential nature of the Program. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA as follows: <br />Section I. Chapter 17, Article 7, Section 17 -56, subpart (a) shall be amended to read in its <br />entirety as follows: <br />fund. Sec. 17 -56.
