Maradik <br />ADOPT RESOLUTION NO. 32 -2015 — RECOMMENDING APPROVAL OF THE <br />DISPOSITION OF PROPERTY LOCATED AT 51190 AND 51270 MAYFLOWER RD <br />Upon a motion made by Ms. Roos, seconded by Mr. Relos and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO. 32-2015 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />RECOMMENDING THE DISPOSITION OF REAL PROPERTY <br />LOCATED AT 51190 MAYFLOWER ROAD AND 51270 MAYFLOWER ROAD, <br />SOUTH BEND, INDIANA <br />WHEREAS, the City of South Bend, Indiana, Board of Public Works (the "Board ") has <br />custody of and may maintain and dispose of all real property owned by the City of South Bend, <br />Indiana (the "City ") pursuant to LC. 36- 1 -11 -3; and <br />WHEREAS, the City is the owner of certain real estate located at 51190 Mayflower Road <br />51270 Mayflower Road, South Bend, St. Joseph County, Indiana, which is more particularly <br />described as <br />Lot Numbered Three (3) as shown on the record Plat of Church's Minor <br />Subdivision, recorded August 9, 2000 as Document Number 0038244 in <br />the Office of the Recorder of St. Joseph County, Indiana <br />And <br />A parcel of land in the Northeast Quarter of Section 17, Township 38 <br />North, Range 2 East, St. Joseph County, Indiana, described as follows: <br />Beginning on the North -South centerline of said Section 17 at the point <br />1330.1 feet South of the North Quarter corner of said Section 17; thence <br />Ease 1740.7 feet to the East line of Partition Lot No. 2 as shown on the <br />partition map in Deed Record 56, page 271 in the office of the Recorder of <br />St. Joseph County; thence South 253 feet; thence West 1741.20 feet to the <br />North -South centerline of said Section; thence North 253 feet to the place <br />of beginning and being known as Lots Numbered Eleven (11) and Twelve <br />(12) in Mayflower Place Proposed <br />(collectively referred to as the "Properties "); and <br />WHEREAS, the average appraised value of the combined Properties is Two Hundred <br />Thirty -Six Thousand and 00 /100 ($236,000.00); and <br />WHEREAS, I.C. 36- 1 -11 -3 requires the approval of the executive of the political <br />subdivision, i.e., the Mayor of the City of South Bend and further fox every sale of real <br />property having an appraised value of Fifty Thousand Dollars or more, the approval of the <br />fiscal body of the unit, i.e., the Common Council of the City of South Bend; and <br />WHEREAS, I.C. 36- 1 -11 -3 requires the executive to conduct a public hearing after <br />giving notice under I.C. 5 -3 -1 and to designate a board or commission of the municipality to <br />give notice, conduct the hearing and notify the executive of its recommendation; and <br />WHEREAS, the Board has given notice of a public hearing by publication on June 12, <br />2015, and has conducted a public hearing concerning the proposed disposition of the <br />Properties, and has considered the comments made at such hearing. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND AS FOLLOWS: <br />
