Maradik ADOPT RESOLUTION NO. 32 -2015 — RECOMMENDING APPROVAL OF THE DISPOSITION OF PROPERTY LOCATED AT 51190 AND 51270 MAYFLOWER RD Upon a motion made by Ms. Roos, seconded by Mr. Relos and carried, the following Resolution was adopted by the Board of Public Works: RESOLUTION NO. 32-2015 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, RECOMMENDING THE DISPOSITION OF REAL PROPERTY LOCATED AT 51190 MAYFLOWER ROAD AND 51270 MAYFLOWER ROAD, SOUTH BEND, INDIANA WHEREAS, the City of South Bend, Indiana, Board of Public Works (the "Board ") has custody of and may maintain and dispose of all real property owned by the City of South Bend, Indiana (the "City ") pursuant to LC. 36- 1 -11 -3; and WHEREAS, the City is the owner of certain real estate located at 51190 Mayflower Road 51270 Mayflower Road, South Bend, St. Joseph County, Indiana, which is more particularly described as Lot Numbered Three (3) as shown on the record Plat of Church's Minor Subdivision, recorded August 9, 2000 as Document Number 0038244 in the Office of the Recorder of St. Joseph County, Indiana And A parcel of land in the Northeast Quarter of Section 17, Township 38 North, Range 2 East, St. Joseph County, Indiana, described as follows: Beginning on the North -South centerline of said Section 17 at the point 1330.1 feet South of the North Quarter corner of said Section 17; thence Ease 1740.7 feet to the East line of Partition Lot No. 2 as shown on the partition map in Deed Record 56, page 271 in the office of the Recorder of St. Joseph County; thence South 253 feet; thence West 1741.20 feet to the North -South centerline of said Section; thence North 253 feet to the place of beginning and being known as Lots Numbered Eleven (11) and Twelve (12) in Mayflower Place Proposed (collectively referred to as the "Properties "); and WHEREAS, the average appraised value of the combined Properties is Two Hundred Thirty -Six Thousand and 00 /100 ($236,000.00); and WHEREAS, I.C. 36- 1 -11 -3 requires the approval of the executive of the political subdivision, i.e., the Mayor of the City of South Bend and further fox every sale of real property having an appraised value of Fifty Thousand Dollars or more, the approval of the fiscal body of the unit, i.e., the Common Council of the City of South Bend; and WHEREAS, I.C. 36- 1 -11 -3 requires the executive to conduct a public hearing after giving notice under I.C. 5 -3 -1 and to designate a board or commission of the municipality to give notice, conduct the hearing and notify the executive of its recommendation; and WHEREAS, the Board has given notice of a public hearing by publication on June 12, 2015, and has conducted a public hearing concerning the proposed disposition of the Properties, and has considered the comments made at such hearing. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND AS FOLLOWS:
