-44- <br />If the Plumbing Inspector, for any reason, ma,, not <br />certify the final inspection of any plumbing or drainage <br />work as meeting with the requirements of this Ordinance <br />he shall notify the owner of the property and the Employing <br />plumber in writing of his decision and he shall also <br />notify the Board of Health and he shall specifically set <br />forth wherein the work or material does not conform to <br />this Ordinance. <br />Section CLXVII. Any person dissatisfied with the <br />decision of the Plumbing Inspector may appeal to the <br />Board of Health and said Board shall set a time for a <br />hearing. This hearing shall be conducted by the Board <br />of Health as other hearings are now conducted before it <br />and its decision shall be final except that the losing <br />party may appeal to the St. Joseph Circuit or Superior <br />Court. <br />Section CLXVIII. If any section or part thereof of <br />this Ordinance is held unconstitutional the remaining sections <br />or provisions shall be given full force and effect as <br />completely as if the part held unconstitutional had not been <br />included herein. <br />Section CLXIX. Any person who shall come under this <br />Ordinance refusing, failing or neglecting to comply with <br />any of the provisions of this Ordinance shall be deemed <br />guilty of a misdemeanor and upon conviction shall be <br />subject to a finefbr not less than Ten ($1000) Dollars <br />or more than Three Hundred ($300.00) Dollars or imprisoned <br />for not less than ten (10) days nor more than thirty (30) <br />days, or both. <br />Section CLXX. No person shall be imprisoned under <br />this Ordinance for the first offense and the prosecution <br />shall always be as and for the first offense unless the <br />
