GENERAL ORDINANCE NO. <br />AN ORDINANCE TO PROMOTE PUBLIC HEALTH BY PROVIDING SANITARY AND <br />HEALTH REGULATIONS FOR BARBER SHOPS AND ESTABLISHMENTS AND IN <br />THE PRACTICES OF BARBERING; PROVIDING FOR SUPERVISION AND <br />INSPECTION AND PRESCRIBING PENALTIES FOR VIOLATIONS. <br />SECTION ONE. DEFINITIONS: Unless the context otherwise <br />requires, the following terms as used in this ordinance shall <br />be construed according to the definitions given below. <br />BARBER. Every person who shaves or trims the beard or <br />cuts the hair, or gives facial or scalp massage or facial or <br />scalp treatments with oil or cream and other preparations made <br />for that purpose, either by hand or by mechanical appliances, <br />or singes or shampoos the hair, or applies hair tonic to or <br />dyes the hair of any person, provided; however, nothing in this <br />ordinance shall be construed to include a person performing such <br />services upon members of his immediate family, person licensed <br />by law of this state to practice medicine or surgery also under- <br />takers, morticians and registered nurses, in connection with <br />their professional duties. Registered beauty culturists under <br />the Indiana Beauty Culture Act, shall be exempt from this Act <br />insofar as covered in the Beauty Culture Act, and they shall be <br />permitted to cut, trim or snip, the stray or straggling ends <br />of hair of a patron or customer incidental to and in connection <br />with arranging or dressing of a woman's hair. <br />BARBER SHOP. Any place where the aforesaid work of business <br />of a Barber is performed; the term shall include Barber School, <br />and Barber College and shall be any premises, buildings, or any <br />parts of a building or place whereupon or within which any <br />combination of the practice of barbering as herein defined is <br />carried on. <br />BARBER CHAIR. Shall include each and every chair, stool <br />or contrivance on which a person sits or reclines for the purpose <br />of receiving any of the services rendered by a Barber as de- <br />fined by this Ordinance. <br />PERSON: To include an individual, firm, corporation or <br />o- partnership. <br />SINGULAR. <br />Shall <br />include <br />plural. <br />MASCULINE <br />GENDER. <br />Shall <br />include feminine gender. <br />SECTION TWO. It shall be unlawful for any person to engage <br />in the business of Barbering or operating a Barber Shop without <br />first having obtained a City License therefor. <br />SECTION THREE. APPLICATION REQUIREMENTS. Every person <br />esiring a license to engage in the business of Barbering or <br />onducting or operating a Barber Shop in the City of South Bend <br />hall appear in person at the office of the Health Director, in the <br />ity of South Bend and make application therefor, giving the <br />ollowing information: <br />
