account of rain or some other act of God. <br />SECTION IV — Before any license or permit shall be issued to any per- <br />son, persons, .firm or corporation, they shall. file with the City Con- <br />troller a contradt and policy of public liability and property damage <br />Insurance of not less than $5,000.00 per individual or a. total of not <br />less than $100,000.00 per accident, showing that the public who attend <br />said race or contest to be held shall be fully protected as to their <br />person and their property, that said Insurance shall be deemed to be <br />for the protection of the public and that said Insurance shall be ex- <br />ecuted by an Insurance Company authorized to do business in the State <br />of Indiana, with a. paid in capital stock of not less than a Million <br />Dollars and that said Insurance policy shall be conditioned upon the <br />payment of any claims of whatsoever nature arising out of the conduct <br />of such races and for the payment of any judgment that may be obtained <br />against the holder, conductor or promoter of such races or against <br />any dilver, chauffeur , employee, or agent connected with such races <br />arising out of any claim or claims for damages to property of or in- <br />jury to any spectator occurring as a result of such races. <br />SECTION V — Before any applicant shall be granted a license for the <br />holding or conducting of any automobile race,.the licensee must have <br />erected or cause to be erected a suitable retaining wall not less than <br />20 feet in front of all spectators who are not admitted to or seated <br />in a protected grandstand and that under no circumstances shall a lic- <br />ense be granted to hold any such races upon any premises which are not <br />equipped with a grandstand for the seating and protection of all persons <br />viewing such races or a, suitable retaining wall erected not less than <br />20 feet from said spectator's and in front thereof and that said retain- <br />ing wall shall be constructed of concrete of not less than 4 feet in <br />width, at the bottom, and not less than 2 feet, at the top, and that <br />the same shall be constructed not less than 4 feet high from the <br />ground surface. <br />
