Approving the Contract between Board of Public Works & Safety and Indepedent Concrete Pipe Corp.

C O N T R A C T This agreement entered into by and between the City of South Bend, by and through its Board of Public V�orks and Safety, hereinafter referred to as the City, and the Independent Concrete Pipe Corporation, Incorporated, herein- after referred to as t he Contractor, VVITITESSETH: Thet the Contractor hereby agrees to f urnish to the City of South Bend One Hundred Forty (140) Feet, more or less, of Thirty -six inch (36 ") Concrete Pipe, American Society Testing Materials Standard C 76- Table 1, which pipe is to be furnished tot he City on or before September 19th, 1940, and is to be delivered to the North Michigan Street Sewer Project. The City agrees to pay the Contractor the sum of Two & 65/100 02.65) Dollars per foot for said pipe within thirty days after delivery and acceptance. It is further agreed that the Contractor will furnish the City of South Bend Eleven Hundred Sixty (1160) Feet, more or less, of Thirty-six inch (36 ") reinforced Concrete Pipe, American Society Testing Materials Standard C 76 - Table 2,a at a price of Two & 85/100 (w2.85) Dollars per foot. Said pipe to be delivered on the North Tichigan Street Sewer Project as directed by the City Engineer. The Contractor agrees to deliver said pipe at the rate of not less than fifty (50) feet per day, beginning on 23 rd '(C.EwJ the -G&t4!i day of September, 1940, and continuing until the entire pipe is delivered. Payment is to be made by the City of South Bend within thirty (30) days after delivery and acceptance. It is agreed by and between the parties that all pipe must meet specifications herein specified and such additional specifications as are required by the City Engineer, City of South Bend, and that no pipe will be accepted or paid
