CONTRACT This contract made and entered into this 7th day of January, 1947, by and between the Board of Water Works Commissioners of the City of South Bend, Indiana, hereinafter referred to as "City" and Thomas L. Hickey, Inc., an Indiana Corporation, hereinafter referred to as "Contractor", WITNESSETH, That, WHEREAS, on the 20th and 27th days of December, 1946, the City advertised for bids on the construction of two well pump houses, WHEREAS, bids were received on the 6th day of January, 1947, and WHEREAS, the bid of the Contractor was found by the City to be the lowest and best bid'. NOW TBEREFORE, in consideration of the mutual promises hereafter contained, the parties hereto hereby agree as follows: 1. The City agrees to pay to Contractor the sum of $11,976.00 for furnishing materials and constructing two well pump houses as per plans and specifications as prepared by the Engineering Department of the City Water Works and as supplied by the City to said Contractor prior to. the submission of the Contractor's bid. 2. The Contractor agrees to construct the said well pump houses in accordance with said plans and specifications and agrees to fulfill the terms of the proposal submitted by said Contractor under date of January 6, 1947. 3. It is agreed between the parties that the completion date for said well pump houses shall be extended in the following fashion: The Contractor shall have the total of 90 days in which to complete construction of each of the well pump houses from and after the date upon which the Contractor receives notide from the City, in writing, at its office at 712 North Niles Avenue, South Bend, Indiana, that work shall be begun on said project.
