RESOLUTION NO. <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, SUPPORTING THE SOLID WASTE MANAGEMENT DISTRICT OF ST. <br />JOSEPH COUNTY'S DECISION TO PROVIDE TOTAL DISTRICT -WIDE CURBSIDE <br />COLLECTION OF RECYCLABLE MATERIALS IN THE CITY OF SOUTH BEND. INDIANA <br />Vbtrtas, the South Bend Common Council acknowledges that on March 10, 1997, the <br />Solid Waste Management District of St. Joseph County adopted Resolution No. 5 -97 which called <br />for mandatory curbside recycling by means of competitively bid contracts; and <br />Vtjtrt48, the City of South Bend's representatives to the Solid Waste Management <br />district of St. Joseph County are the Mayor Stephen J. Luecke and Council Member John <br />Broden; and <br />"fit eVMZ, pursuant to Indiana Code § 13- 21 -3 -12 (17), the City of South Bend is <br />required to adopt a concurring Resolution in order for mandatory curbside recycling services can <br />be provided within the city limits. <br />Aft, Z0rtf0Vt, V4 It 00SiUO by the Common Council of the City of South <br />Bend, Indiana, as follows: <br />Section I. The Common Council and the City Administration of the City of South Bend, <br />St. Joseph County, Indiana, acknowledge the mandatory curbside recycling program developed by <br />the Solid Waste Management District of St. Joseph County. <br />Section II. The City of South Bend acknowledges that the Solid Waste Management <br />District of St. Joseph County has determined that mandatory curbside recycling will be provided <br />by the District at a reasonable cost and that such service will benefit the public health, welfare and <br />safety of the residents of the District. <br />Section III. The Common Council and the City Administration hereby resolve to <br />support and authorize implementation of the mandatory curbside recycling service within the <br />municipal boundaries of South Bend requiring participation by all single family residences and <br />rental complexes with fewer than five (5) units. <br />Section IV.
