BILL NO. 98-125 as amended 7 -27 -98 <br />RESOLUTIONNO. 66-9 -9 � <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />SUPPORTING THE SOLID WASTE MANAGEMENT DISTRICT OF ST. JOSEPH COUNTY'S <br />DECISION TO PROVIDE TOTAL DISTRICT -WIDE CURBSIDE COLLECTION OF <br />RECYCLABLE MATERIALS IN THE CITY OF SOUTH BEND INDIANA <br />"DUneress, the South Bend Common Council acknowledges that on March 10, 1997, the <br />Solid Waste Management District of St. Joseph County adopted Resolution No. 5 -97 which called for <br />mandatory curbside recycling by means of competitively bid contracts; and <br />Wtiere8g, the City of South Bend's representatives to the Solid Waste Management district <br />of St. Joseph County are the Mayor Stephen J. Luecke and Council Member John Broden; and <br />V b Mlta.g, pursuant to Indiana Code § 13- 21 -3 -12 (17), the City of South Bend is required to <br />adopt a concurring Resolution in order for mandatory curbside recycling services can be provided <br />within the city limits. <br />)Ntn, Ztere£ore, Ve Xt 008ttt¢4 by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />Section L The Common Council and the City Administration of the City of South Bend, St. <br />Joseph County, Indiana, acknowledge the mandatory curbside recycling program developed by the <br />Solid Waste Management District of St. Joseph County. <br />Section H. The City of South Bend acknowledges that the Solid Waste Management District <br />of St. Joseph County has determined that mandatory curbside recycling will be provided by the District <br />at a reasonable cost and that such service will benefit the public health, welfare and safety of the <br />residents of the District. <br />Section III. The Common Council and the City Administration hereby resolve to support <br />and authorize implementation of the mandatory curbside recycling service within the municipal <br />boundaries of South Bend requiring participation by all single family residences and rental complexes <br />with fewer than five (5) units; and do hereby urge the Solid Waste Management District of St. Joseph <br />County to develop and adopt a mandatory recycling program for residential complexes in excess of <br />four (4) units. <br />Section IV.
