<br />Mr. Gilot advised that Mr. Paul South, Street Department, has submitted Change Order No. 1
<br />(Final) on behalf of Pemberton -Davis Electric, 918 McKinley Ave., Mishawaka, Indiana 46545,
<br />indicating the contract amount be decreased by $1,010.30 for a new contract sum, including this
<br />Change Order, of $9,801.70. Additionally submitted was the Project Completion Affidavit
<br />indicating this new final cost of $9,801.70. Upon a motion made by Mr. Relos, seconded by Mr.
<br />Henthorn and carried, Change Order No. 1 (Final) and the Project Completion Affidavit were
<br />approved.
<br />APPROVE PROJECT COMPLETION AFFIDAVIT — JEFFERSON BOULEVARD
<br />STREETSCAPE IMPROVEMENTS —PROJECT N0. 114-001 (MAJOR MOVES)
<br />Mr. Gilot advised that Mr. Toy Villa, Engineering, has submitted the Project Completion
<br />Affidavit on behalf of Selge Construction Co., Inc., 2833 South ll'h Street, Niles, Michigan
<br />49120, for the above referenced project, indicating a final cost of $1,603,685,70. Upon a motion
<br />made by Mr. Relos, seconded by Mr. Henthorn and carried, the Project Completion Affidavit
<br />was approved.
<br />APPROVE PROJECT COMPLETION AFFIDAVIT — TWO-WAY CONVERSION OF
<br />WILLIAM ST. AND LAFAYETTE BLVD. — PROJECT NO. 112-065B (MAJOR MOVES)
<br />Mr. Gilot advised that Mr. Toy Villa, Engineering, has submitted the Project Completion
<br />Affidavit on behalf of Rieth-Riley Construction Co., Inc., 25200 S.R. 23, South Bend, Indiana
<br />46614, for the above referenced project, indicating a final cost of $413,588.40, Upon a motion
<br />made by Mr. Relos, seconded by Mr. Henthorn and carried, the Project Completion Affidavit
<br />was approved
<br />APPROVE PROJECT COMPLETION AFFIDAVIT — REMOVAL AND DISPOSAL OF
<br />HAZARDOUS/NON-HAZARDOUS MATERIALS AT IVY TOWER — PROJECT NO 114-

<br />Mr. Gilot advised that Ms. Thia Vawter, Engineering, has submitted the Project Completion
<br />Affidavit on behalf of Industrial & Environmental Services LLC, 7550 E. Melton Road, Gary,
<br />Indiana 46403, for the above referenced project, indicating a final cost of $26,838.00. Upon a
<br />motion made by Mr. Relos, seconded by Mr. Henthorn and carried, the Project Completion
<br />Affidavit was approved.
<br />ADOPT RESOLUTION NO. 58-2014 — DESIGNATING THE CITY OF SOUTH BEND
<br />DEPARTMENT OF CODE ENFORCEMENT TO CARRY OUT DUTIES RELATED TO
<br />PUBLIC NUISANCES
<br />Upon a motion made by Mr. Pawlowski, seconded by Mr. Henthorn and carried, the following
<br />Resolution was adopted by the Board of Public Works:

<br />A RESOLUTION OF THE BOARD OF WORKS FOR THE CITY OF SOUTH BEND,
<br />INDIANA DESIGNATING THE CITY OF SOUTH BEND DEPARTMENT OF CODE
<br />ENFORCEMENT TO CARRY OUT DUTIES RELATED TO PUBLIC NUISANCES
<br />WHEREAS South Bend Municipal Code Chapter 2, Article 4, Section 2-13 establishes
<br />the Code Enforcement Department and the Public Works Department for the City of South Bend.
<br />Whereas South Bend Municipal Code Chapter 2, Article 4, Section 2-13(B)(8) provides
<br />that the Code Enforcement Department performs administrative tasks related to substandard
<br />buildings, license inspection and enforcement, environmental code enforcement, weights and
<br />measures, and citizen service center.
<br />WHEREAS South Bend Municipal Code Chapter 2, Article 4, Section 2-13(B)(3)
<br />provides that the Public Works Department performs administrative duties related to engineering
<br />management of streets, including duties related to municipal services, parking, traffic control,
<br />and street lighting, sanitation, sewers, wastewater treatment, water works and vehicle
<br />maintenance.
<br />WHEREAS South Bend Municipal Code Chapter 16, Article 8, Section 16-53 identifies
<br />conditions constituting a public nuisance on properties within the City.
