<br />Mr. Gilot advised that Mr. John Wiltrout, Water Works, has submitted Change Order No. 4
<br />(Final) on behalf of L. D. Docsa Associates, Inc., 1605 King Highway, Kalamazoo, Michigan
<br />49001, indicating the contract amount be decreased by $52,640.74 for a new contract sum,
<br />including this Change Order, of $3,287,755.67. Mr. Wiltrout also requested the Board's approval
<br />of the assessment of eighteen (18) days of liquidated damages. Additionally submitted was the
<br />Project Completion Affidavit indicating this new final cost of $3,287,755.67. Attorney Greene
<br />noted a memo has been submitted to the Board detailing all of the damages. Mr. Gilot noted an
<br />email was received by the Board stating that L.D. Docsa does not agree with the charges. Ms.
<br />Greene stated it is the Board's discretion to make the final decision. Mr. Gilot asked Mr. Eric
<br />Horvath, Director of Public Works, for his recommendation. Mr. Horvath recommended the
<br />Board move forward with the Change Order and Completion Affidavit and if L.D. Docsa has
<br />issues with it they can put it in writing to the Board for further review. Upon a motion made by
<br />Ms. Roos, seconded by Mr. Henthom and carried, Change Order No. 4 (Final) and the Project
<br />Completion Affidavit were approved.

<br />Mr. Gilot advised that Mr. Jacob Klosinski, Environmental Services, has submitted Change
<br />Order No. 1 (Final) on behalf of Selge Construction Company, Inc., 2833 S. 1 lth Street, Niles,
<br />Michigan 49120, indicating the contract amount be increased by $31,405.98 for a new contract
<br />sum, including this Change Order, of $579,190.98. Additionally submitted was the Project
<br />Completion Affidavit indicating this new final cost of $579,190.98. Upon a motion made by Mr.
<br />Henthorn, seconded by Mr. Relos and carried, Change Order No. 4 (Final) and the Project
<br />Completion Affidavit were approved.

<br />advertise for the receipt of bids for the above referenced project. Mr. George King, Purchasing,
<br />stated he has received the requested final approval from Lippert Components of the bid
<br />specifications. Therefore, upon a motion made by Ms. Roos, seconded by Mr. Relos and carried,
<br />the above request was approved.

<br />In a memorandum to the Board, Mr. John Engstrom, Engineering, requested permission to
<br />advertise for the receipt of bids for the above referenced project. Mr. George King, Purchasing,
<br />stated he has not received a final approval of the bid specifications from Noble America for this
<br />purchase as requested by the Board. Therefore, upon a motion made by Ms. Roos, seconded by
<br />Mr. ReIos and carried, the above request was approved subject to Noble America's approval of
<br />the bid specifications.
<br />REQUEST TO ADVERTISE FOR THE SALE OF CITY -OWNED PROPERTY 738
<br />LELAND AVENUE
<br />In a memorandum to the Board, Ms. Pam Meyers, Community Investment, stated her
<br />Department is interested in disposing of City owned property at 738 Leland Avenue. She noted
<br />in her memorandum that the successful bidder must meet five (5) criteria set out in the Notice to
<br />Bidders and the bids will be weighted based on the documentation that is provided by the bidder.
<br />Ms. Meyer made note that the property has lost its legal non -conforming status with the Building
<br />Department and is zoned S172 and must be renovated to a single family dwelling. This work, she
<br />added may need to be approved by the Historic Preservation Commission as it is located in a
<br />
