<br />ADOPT RESOLUTION NO. 31-2014 — A RESOLUTION OF THE CITY OF SOUTH BEND
<br />BOARD OF PUBLIC WORKS AMENDING RESOLUTION NO. 21-2014 TO CLARIFY THE
<br />EFFECTIVE DATE FOR APPLICATION OF COMMON CONSTRUCTION WAGE RATES TO
<br />PUBLIC WORKS PROJECTS ESTIMATED TO COST LESS THAN $350 000 AND MORE
<br />THAN $175,000
<br />Upon a motion made by Ms. Roos, seconded by Mr. Relos and carried, the following Resolution
<br />was adopted by the Board of Public Works:
<br />RESOLUTION NO 31-2014
<br />A RESOLUTION OF THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS
<br />AMENDING RESOLUTION NO.21-2014 TO CLARIFY THE EFFECTIVE DATE FOR
<br />APPLICATION OF COMMON CONSTRUCTION WAGE RATES TO PUBLIC WORKS
<br />PROJECTS ESTIMATED TO COST LESS THAN $350,000 AND MORE THAN $175,000
<br />WHEREAS, the City of South Bend ("City") desires that workers on public work
<br />contracts be compensated fairly for the application of their skills and training; and
<br />WHEREAS, in accordance with Indiana Code §5-16-7-1, et seq. the Indiana Department
<br />of Labor administers a program for determination of Common Construction Wage Rates for public
<br />construction on public works projects; and
<br />WHEREAS, in accordance with Indiana Code §5-16-7-1(m), the City is not required to pay
<br />Common Construction Wage Rates on public works projects having an estimated cost of less than
<br />$350,000; and
<br />WHEREAS, the City, acting through its Board of Public Works ("Board"), frequently
<br />contracts for smaller public work projects estimated to cost more than $175,000, but estimated to
<br />cost less than $350,000; and
<br />WHEREAS, on July 8, 2014, the Board adopted its Resolution No. 21-2104 providing for
<br />application of Common Construction Wage Rates to smaller public work projects estimated to cost
<br />more than $175,000, but estimated to cost less than $350,000; and
<br />WHEREAS, the Board desires to clarify its intent as to the effective date for application of
<br />Common Construction Wage Rates to smaller projects so that those persons or companies in the
<br />Process of submitting bids or quotes in response to such projects would not be disadvantaged by
<br />changes required by implementation of the new policy adopted on July 8, 2014; and
<br />WHEREAS, the Board hereby states its intent in adopting Resolution No. 21-2014 was to
<br />ensure that Common Construction Wage Rates be applied to smaller public work projects estimated
<br />to cost more than $175,000, but estimated to cost less than $350,000 for those projects being bid or
<br />offered after July 8, 2014 through and including December 31, 2014, and that those projects which
<br />had been advertised or offered prior to July 8, 2014 shall not be effected by the new policy.
<br />NOW, THEREFORE, BE IT RESOLVED by the City of South Bend Board of Public
<br />Works that:
<br />The effective date for application of Common Construction Wage Rates to smaller
<br />public works projects having an estimated cost of more than $175,000, but estimated to
<br />cost less than $350,000 shall be July 8, 2014.
<br />2. Public works projects which had been publically bid or offered in accordance with State
<br />law prior to the adoption of Resolution No. 21-2014 on July 8, 2014 shall not be affected
<br />by the new policy.
