Lessor does not warrant that any of the services above mentioned will be free from interruptions <br />caused by repairs, renewals, improvements, alterations, strikes, lockouts, accidents, inability of <br />Lessor to obtain fuel or supplies, or any other cause beyond the reasonable control of Lessor. <br />Any such interruption of service will not constitute an eviction or disturbance of Lessee's use and <br />possession of the Premises, or any part thereof, or render Lessor liable to Lessee for damages, or <br />relieve Lessee from performance of Lessee's obligations under this Lease. Lessor will use <br />reasonable efforts to promptly remedy any situation which has interrupted such services. <br />ARTICLE V <br />MAINTENANCE REPAIRS IMPROVEMENTS AND ALTERATIONS <br />5.1 Lessee's Work. Lessee shall, at Lessee's expense, complete the <br />improvements to the Premises set forth on Exhibit C attached hereto and incorporated herein by <br />reference ( "Lessee's Work "). With the exception of Lessee's Work, Lessee shall accept <br />possession of the Premises "as is" without representation or warranty of any kind and Lessor <br />shall have no further obligation to improve the Premises. <br />5.2 Necessary Repairs. Lessor shall make all necessary repairs to the Building <br />and Common Areas, and Lessor shall keep the Building and Common Areas in a safe, clean and <br />neat condition and use reasonable efforts to keep all equipment used in common with the Lessor <br />or other Lessees in good condition and repair, provided, however, that to the extent any of the <br />foregoing items require repair because of the intentional misconduct, misuse or default of <br />Lessee, its employees or agents, Lessor shall make such repairs solely at Lessee's expense. <br />Lessor shall keep and maintain the Premises in good order, condition and repair, provided, <br />however, that to the extent any items in the Premises require repair because of the intentional <br />misconduct, misuse or default of Lessee, its employees or agents, Lessor shall make such repairs <br />solely at Lessee's expense. <br />5.3 Alterations. Lessee shall not make any alterations, additions or leasehold <br />improvements to the Premises during the term of this Lease or make any contract therefor <br />without first procuring Lessor's written consent. All alterations, additions and /or leasehold <br />improvements made by Lessee to or upon the Premises, except Lessee's personal property and <br />removable trade fixtures installed by Lessee, shall at once when made or installed be deemed to <br />have attached to the freehold and to have become the property of Lessor. Lessee shall be <br />responsible for any damages occasioned by removal of its personal property and trade fixtures. <br />Any alterations made by Lessee shall be at Lessee's cost and expense. Lessee agrees to conform <br />to and comply with all laws, ordinances, rules and regulations of federal, state, county and <br />municipal authorities in making such alterations or repairs, and shall at all times keep the <br />Premises free from claims of mechanics' liens. <br />5.4 Access to Premises. Lessor and its agents shall have reasonable access to <br />the Premises during all hours for the purpose of examining the same and to ascertain that they <br />are in good repair, and to make reasonable repairs which Lessor may desire to make hereunder. <br />5.5 Utility Charges.
