Staff Report 5/9/2014 <br />Utilities: <br />The site is served by municipal water and sewer. <br />Agency Comments: <br />The City Engineer would be opposed to changes along the State Road 23 frontage, but has <br />no objections to the requested variance along the side property lines. The Department of <br />Community Investment does not have objections to the proposed rezoning provided the <br />new owner maintains an orderly layout for vehicle parking and landscaping is provided <br />where possible to beautify the property. <br />Commitments: <br />The petitioner is not proposing any written commitments. <br />Criteria to be considered in reviewing rezoning requests, per IC 36 -7 -4 -603: <br />1. Comprehensive Plan: <br />Policy Plan: <br />The rezoning is consistent with the Comprehensive Plan. City Plan, South Bend <br />Comprehensive Plan (November 2006) Policy ED 1.2 Encourage reuse of abandoned and <br />underutilized land and structures. <br />Land Use Plan: <br />The future land use map identifies this area as commercial. <br />Plan Implementation /Other Plans: <br />There are no other plans for this area. <br />2. Current Conditions and Character: <br />The site is currently vacant. <br />3. Most Desirable Use: <br />The most desirable use for the site is commercial. <br />4. Conservation of Property Values: <br />The surrounding property values should not be affected. The proposed rezoning is for the <br />expansion of a current business on an existing commercial lot. <br />5. Responsible Development And Growth: <br />It is responsible development and growth to encourage the redevelopment of vacant <br />commercial properties. <br />Staff Comments: <br />This is a combined public hearing procedure, which includes a rezoning and four <br />variances from the development standards. The Commission will forward the rezoning to <br />the Common Council with or without a recommendation and either approve or deny the <br />variances. <br />The variances are as follows: <br />1) from the required 30' minimum front yard to 0' for parking; <br />2) from the required 30'minimum side residential bufferyard to 0; <br />3) from the required Type C: Full Screening landscaping to a 6' privacy fence for the <br />north 55' of the west property line; and <br />APC # 2705 -14 Page 2 of 3 <br />
