Staff Report 5/9/2014 <br />APC # 2705 -14 <br />Owner: Cosimo and Maria Bumbaca <br />Location: 1707 South Bend Avenue <br />Jurisdiction: City of South Bend <br />Public Hearing Date: 5/20/2014 <br />Requested Action: <br />The petitioner is requesting a zone change from LB Local Business District to GB General <br />Business District and four variances to allow uses permitted in the GB General Business <br />District. <br />Land Uses and Zoning: <br />On site: On site are the remains of a commercial structure damaged by fire zoned <br />LB Local Business District. <br />North: To the north is a used auto sales lot and beauty salon zoned GB General <br />Business District. <br />East: To the east are the Oak Hill Condominiums zoned MF2 High- Density <br />Multifamily District and a gas station zoned CB Community Business <br />District. <br />South: To the south is a restaurant zoned LB Local Business District. <br />West: To the west is Clover Village Apartments zoned MF2 High - Density <br />Multifamily District and a restaurant zoned LB Local Business District. <br />District Uses and Development Standards: <br />The GB General Business District is established to provide a location for those retail sales <br />and service functions whose operations are typically characterized by: outdoor display or <br />sales of merchandise; major repair of motor vehicles; commercial amusement and <br />recreational activities; or, activities or operations conducted in structures which are not <br />completely enclosed. The types of uses found in the GB District are often brightly lighted <br />and noisy. Permitted uses contained in this district are such that this district may be used <br />to form a grouping of similar uses along certain portions of major commercial <br />thoroughfares. Special attention should be paid to buffering whenever this district is <br />located adjacent to any residential district or residential uses. <br />Site Plan Description: <br />The site is 0.25 acres. The proposed site plan includes a paved lot with a proposed 6' <br />privacy fence along the northern portion of the west property line. One deciduous shade or <br />ornamental tree is proposed at the southern corner of the lot. The remainder of the lot will <br />be used for outdoor display for auto sales. <br />Zoning and Land Use History And Trends: <br />The properties along State Road 23 have been zoned for commercial purposes <br />Traffic and Transportation Considerations: <br />State Road 23 (South Bend Avenue) has four lanes with a turn lane that begins just south <br />of the subject property. <br />APC # 2705 -14 Page 1 of 3 <br />
