TO: THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA. <br />Petitioners, HARTMAN BUILDERS, INC., an Indiana Corpora- <br />tion, and THOMAS JOSEPH SZABO, JR. , single and of adult age, <br />by their attorneys, Butler & O'Malley, respectfully petition that <br />Ordinance No. 3702, adopted by the Common Council on the 13th <br />day of June, 1949, and commonly known as the Zoning Ordinance, <br />be amended as follows, to -wit: <br />Lots Numbered 23, 24 and 25 and <br />Lots Numbered 46, 47 and 48 in <br />Alward's Subdivision to the City of <br />South Bend, Indiana, <br />be changed from "B" Residence and "A" Height and Area District, <br />to "C" Commercial and "E" Height and Area District. <br />Petitioner HARTMAN BUILDERS, INC., further states that <br />it is the owner of Lots Numbered 23, 24 and 25 of the above - described <br />property. <br />Petitioner THOMAS JOSEPH SZABO, JR. , further states <br />that he is the owner of Lots Numbered 46, 47 and 48 of the above- <br />described property, and that said real estate is now being used by <br />him for commercial purposes, to -wit: a motel under an authorized <br />variance of use issued to him. <br />Petitioners further state that they have attached hereto a form <br />of ordinance for the convenience, use and approval of the Common <br />Council of the City of South Bend. <br />WHEREFORE, Petitioners respectfully request that the <br />Common Council of the City of South Bend, Indiana, accept and act <br />favorably upon their said petition and that the property herein described <br />
