(c) The respondent shall have the right to file answer to the complaint <br />and appear at such hearing to testify in his own behalf, or to be re- <br />presented by counsel or otherwise, and to examine and cross- examine <br />witnesses. <br />(d) If upon all the evidence taken, the Commission by a majority vote <br />shall determine that the respondent committed the discriminatory prac- <br />tice set forth in the complaint, the Commission shall issue an order <br />directing the respondent to cease such discriminatory employment prac- <br />tice so found to be engaged in. The Commission shall have power to <br />require proof of compliance. <br />(e) In the event the respondent refuses or fails to comply with any suc <br />order issued by the Commission, the Commission shall certify the case <br />and the entire record of its proceedings to the City Department of Law <br />who shall invoke the aid of an appropriate court to impose the penalties <br />provided in Section 10 of this ordinance and by appropriate action en- <br />forcement of the order. <br />SECTION 10. Penalty <br />Any person who shall violate any of the provisions of the ordinance or a <br />of the rules and regulations adopted thereunder or who shall fail, refus <br />or neglect to comply with any order or decision of the South Bend Fair <br />Employment Commission shall be subject for each violation to a fine not <br />exceeding one hundred ($100.00) dollars, provided that prosecutions <br />under this ordinance shall be brought only by the City Department of <br />Law and such prosectuions shall be brought only after certification of <br />a case to it by the Commission. <br />SECTION 11. Severability <br />The provisions of this ordinance are severable and if any provision, <br />sentence, clause, section or part thereof shall be held illegal, invalid <br />unconstitutional or inapplicable to any person or circumstance such <br />illegality, invalidity, unconstitutionality or inapplicability shall not <br />effect or impair any of the remaining provisions, sentences, clauses, <br />sections or parts of the ordinance of their application to other persons <br />or circumstances. It is hereby declared to be the legislative intent <br />that this ordinance would have been adopted if such illegal, invalid <br />or unconstitutional provisions, sentence, clause, section or part had <br />not been included therein and if the person or circumstance to which the <br />ordinance or any part thereof is inapplicable had been specifically <br />exempted therefrom. <br />SECTION 12.
