(c) The respondent shall have the right to file answer to the complaint and appear at such hearing to testify in his own behalf, or to be re- presented by counsel or otherwise, and to examine and cross- examine witnesses. (d) If upon all the evidence taken, the Commission by a majority vote shall determine that the respondent committed the discriminatory prac- tice set forth in the complaint, the Commission shall issue an order directing the respondent to cease such discriminatory employment prac- tice so found to be engaged in. The Commission shall have power to require proof of compliance. (e) In the event the respondent refuses or fails to comply with any suc order issued by the Commission, the Commission shall certify the case and the entire record of its proceedings to the City Department of Law who shall invoke the aid of an appropriate court to impose the penalties provided in Section 10 of this ordinance and by appropriate action en- forcement of the order. SECTION 10. Penalty Any person who shall violate any of the provisions of the ordinance or a of the rules and regulations adopted thereunder or who shall fail, refus or neglect to comply with any order or decision of the South Bend Fair Employment Commission shall be subject for each violation to a fine not exceeding one hundred ($100.00) dollars, provided that prosecutions under this ordinance shall be brought only by the City Department of Law and such prosectuions shall be brought only after certification of a case to it by the Commission. SECTION 11. Severability The provisions of this ordinance are severable and if any provision, sentence, clause, section or part thereof shall be held illegal, invalid unconstitutional or inapplicable to any person or circumstance such illegality, invalidity, unconstitutionality or inapplicability shall not effect or impair any of the remaining provisions, sentences, clauses, sections or parts of the ordinance of their application to other persons or circumstances. It is hereby declared to be the legislative intent that this ordinance would have been adopted if such illegal, invalid or unconstitutional provisions, sentence, clause, section or part had not been included therein and if the person or circumstance to which the ordinance or any part thereof is inapplicable had been specifically exempted therefrom. SECTION 12. Effective Date This ordinance shall be in full force and effect from and after the day of its passage.
