CITY OF SOUTH BEND, INDIANA

<br />AN ORDINANCE ADOPTING THE PROVISIONS OF THE AREA PLANNING
<br />ACT, CHAPTER 138, ACTS OF 1957, INDIANA GENERAL ASSEMBLY,
<br />AS AMENDED
<br />WHEREAS, expanding urbanization within the County of St. Joseph
<br />and the City of South Bend, Indiana, has created many new problems
<br />involving streets and highways) transportation, drainage, water,
<br />land use, schools, and recreation, which are beyyond the ability
<br />of the County) the City) or any other single city or town within
<br />the County to solve; and
<br />WHEREAS, the Area Planning Act, Chapter 138, Acts of 1957, Indiana
<br />General Assembly, as amended, authorizes the County, the City,
<br />and other cities and towns within the County to establish
<br />cooperatively a single and unified planning and zoning agency
<br />to deal with these problems on a county -wide basis so as to
<br />improve the health, safety, convenience, and the welfare of their
<br />citizens and to plan for the future development of the County, the
<br />City, anis�a g ct�e�i�gs�nt County to the
<br />end that/ n w LYo uni ies grow only tai a e'qua d street, utility,
<br />health, educational and recreational facilities; that the needs
<br />of agriculture, industry, and business be recognized in future
<br />growth, that residential.areas provide healthy surroundings for
<br />family life; and that the growth of the County, the City, and
<br />such other cities and towns within the County is commensurate
<br />with and promotive of the efficient and economical use of public
<br />funds;
<br />NOW, THEREFORE, be it ordained by the Common Council of the City
<br />of South Bend, Indiana, that:
<br />Section 1: The provisions of said Area Planning Act creating
<br />an Area Planning Department in the County composed
<br />of an Area Plan Commission, an Area Board of
<br />Zoning Appeals, an Executive Director, and such
<br />staff as the Area Plan Commission considers
<br />necessary, and all other provisions of said Area
<br />Planning Act are hereby adopted.
<br />Section 2: The representatives of the City to the Area Plan
<br />Commission shall be seven (7) in number as provided
<br />by statute, as follows:
<br />A member of the Board of Public Works, the

<br />A member of the Common Council selected by the
<br />;L 2 Council; and five (5) citizen members appointed
<br />by the Mayor,
