Mr. Chris Dressel <br /> March 4,2014 <br /> Page 3 of 18 <br /> In March 2011, the former Millennium building was razed excluding a portion of the building <br /> foundation and concrete floor. In March and April 2012, with IDEM oversight, the remainder of <br /> the building foundation, concrete floor, and two areas of impacted soil beneath the floor were <br /> removed. The concrete floor previously acted as a "cap" (see Figure 1) covering the impacted <br /> soils exceeding industrial default closure levels. One area of impacted soil (30'x 30'x 5' deep) <br /> was located at the former loading dock and drum compactor. Approximately 227.5 tons of <br /> chlorinated solvent contaminated soil was removed and disposed of as nonhazardous waste at <br /> Prairie View Landfill in Wyatt, Indiana. The second location (10' x 12' x 10' deep) was located <br /> at the former conveyor and process control station. Approximately 60.49 tons of hazardous <br /> waste soil was disposed of at Wayne Disposal, Inc. located in Belleville, Michigan. There are no <br /> indications in the Demolition & Soil Excavation Report, prepared by ERS, Inc. dated June 5, <br /> 2012, for IDEM that any soil samples were collected from either excavation to verify that the soil <br /> exceeding default industrial closure screening levels had been removed. However, composite <br /> samples were collected and tested from each roll off container from the first excavation to verify <br /> that the excavated material was non-hazardous. <br /> As a result of the excavation project, the soil is no longer capped across any portion of the <br /> property. The property, as it presently exists, is an open vacant lot, void of any above grade <br /> structural improvement. Weaver Boos understands that a prospective purchaser plans to <br /> redevelop the property into a power station and concrete or asphalt paved parking lot used for <br /> staging equipment and semi trailers. The surface soils will be covered with concrete or asphalt. <br /> The prospective purchaser is seeking an IDEM Comfort Letter from the IBP prior to acquisition. <br /> Based on the current site conditions and background information, the prospective purchaser <br /> would likely be eligible for the IDEM Comfort Letter as long as the conditions outlined in the <br /> 2010 ERC are met. Please note that according to the background information this site is a former <br /> RCRA facility subject to RCRA corrective action requirements and IDEM Comfort Letters likely <br /> do not provide RCRA liability protection, as confirmed by Mr. Kevin Davis of the IDEM IBP. <br /> However, Mr. Davis believes that RCRA was satisfied with the corrective action activities that <br /> occurred in 2012 and will likely not seek further action on the site. Mr. Davis stated that the <br /> groundwater contamination may still be an issue if the conditions outlined in the 2010 ERC are <br /> not met by the prospective purchaser. <br /> 1 <br />
