Bach, 911 Main Street, Indianapolis, Indiana 46220, has <br />submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Area Plan <br />Commission, Fire Department, and Community Investment. Area Plan stated the vacation would <br />not hinder the growth or orderly development of the unit or neighborhood in which it is located <br />or to which it is contiguous. The vacation would not make access to the lands of the aggrieved <br />person by means of public way difficult or inconvenient. The vacation would not hinder the <br />public's access to a church, school or other public building or place. The vacation would not <br />hinder the use of a public right-of-way by the neighborhood in which it is located or to which it <br />is contiguous. Ms. Roos noted the Petitioner will need to complete a Cross -Access Agreement. <br />Therefore, Ms. Roos made a motion recommending approval of the request for vacation. Mr. <br />Henthorn seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE THE FIRST EAST/WEST <br />ALLEY SOUTH OF MISHAWAKA AVENUE FROM CLOVER STREET WEST TO THE <br />FIRST NORTH/SOUTH ALLEY FOR A DISTANCE OF 111.5 FEET AND A WIDTH OF 14 <br />FEET <br />Mr. Gilot indicated that J. HoIm, Holm Rental, LLC, 50733 Tarrington Way, Granger, Indiana <br />46530, has submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board <br />is in receipt of favorable recommendations concerning this Vacation Petition from the Fire <br />Department, Police Department, Community Investment, and the Engineering Department. <br />Community Investment stated that the alley in question serves as a second access to the business <br />on the corner of Mishawaka and Clover St. (Le Candy Shop) and recommends approval of this <br />request provided that this vacation will not create any future access hardship for this business. <br />The Engineering Department stated the vacation would not hinder the growth or orderly <br />development of the unit or neighborhood in which it is located or to which it is contiguous. The <br />vacation would not make access to the lands of the aggrieved person by means of public way <br />difficult or inconvenient. The vacation would not hinder the public's access to a church, school <br />or other public building or place.
